ORDINANCE NO.
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING THAT CERTAIN DRAINAGE AND UTILITY EASEMENT FUR-
THER DESCRIBED HEREIN LOCATED ACROSS PARTS OF LOTS 5-A,
5-B AND 7-R OF THE NORTHPARK BUSINESS CENTER OF THE CITY
OF FORT WORTH; RETAINING SEWER FACILITY EASEMENT; PROVID-
ING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of that certain drainage and utility easement
running in, on, over and across parts of Lots 5-A, 5-B and 7-R of
the Northpark Business Center of the City of Fort Worth and said
portion being described more partic ularl y in Ex hibit "A" attached
hereto and incorporated herein, be and the same is vacated, aban-
doned and permanently closed and extinguished.
SECTION 2.
That the land comprising the above described vacated drainage
and utility easement is hereby released and shall revert to the
adjacent owners as prow ided by law, SAVE AND EXCEPT that an easement
is hereby retained for the existing sewer facility within the
vacated drainage and utility easement and any expansions or altera-
tions thereto
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained .

DESCRIPTION OF PORTION OF EASEMENT FOR VACATION
SITUATED in the City of Fort Worth, Tarrant County, Texas„ and being a portion of that
certain "drainage and utility easement" shown across parts of LOTS 5-A, 5-B, and 7-R,
NORTHPARK BUSINESS CENTER, as shown on plats in Volume 388-109, Pages 59 and 60, and
Volume 388-140, Page 38, of the Plat Records of Tarrant County, Texas, and said portion
being more fully described as follows:
BEGINNING at the most easterly northeast corner of said drainage and utility easement,
in the easterly line of said Lot 5-B and in the westerly line "of Samuels Avenue, said
point being 82.89 feet South 4$ degrees, 2.5 minutes East, and 110.0 feet "South 73
degrees, 54 minutes East from the most northerly corner of~said Lot 5-6,
THENCE South 56 degrees, 18 minutes East with said easterly line afLot 5=B and westerly
line of Samuels Avenue, and. with. an easterly line of said drainage and utility easement,
16.47 feet to the most easterly southeast corner of said easement;
THENCE South 58 degrees, O3 minutes, 20 seconds West with a southerly line of said
drainage and utility easement, 137.01 feet to an angle point in said easement;
THENCE South 14 degrees, 53 minutes, 15 seconds East and parallel with the common line
between said Lots 5-B and 5-A, 243.28 feet to the beginning of a curve whose center bears
South 75 degrees, 06 minutes, 45 seconds West, 80.0 :feet;
THENCE southwesterly with said curve and with a southeasterly line ofi said drainage and
utility easement, crossing the common line between said Lot 5-B and said Lot 7-R, a
distance of 125.69 feet to the end of said curve;
THENCE South 75 degrees, 07 minutes, 40 secands West and para11e1 with the common line
between said Lots 5-A and 7-R, 242.95 feet to the beginning of a curve whose center bears<.

RECOMMENDATION
It is recommeded that the City Council adopt an Ordinance vacating certain
"drainage and utility easement" shown across parts of Lots 5-A, 5-B, and 7-R,
Northpark Business Center, as shown on plats recorded in Volume 388-109, pages 59
and 60, and Volume 388-140, Page 38, P.R.T.C.T., said portion containing 0.863
acre.
DISCUSSION•
Stanley Granger, President, on behalf of Texas Cold Storage, Inc., owner of all
abutting property, has requested that the City vacate the above-described
drainage and utility easement, as shown on the attached map.
The subject portion of a drainage and utility easement, acquired by dedication,
is Matted and contains a sewer line. The responsible entity has requested that
the appropriate easement be retained for the existing sewer facility. The
subject vacation request is made in order to replat the vacated easement with
adjoining property, thus expanding the building area and providing more usable
yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City.
Reviewing City departments and private utility companies have raised no
objections to this request, subject to submission of an acceptable replat of the
easement area with abutting .property and retention/dedication of the required
easements. A satisfactory replat has been submitted.
