ORDINANCE N0. ~~~~~
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING THE TEMPORARY ROAD EASEMENT AND PERMANENT SANI-
TARY SEWER EASEMENT LOCATED IN T.HE WESTERNMOST PORTION OF
TRACT "B", BLOCK 115-R, WEDGWOOD ADDITION, ADJACENT TO THE
RIGHTS-OF-WAY AND INTERSECTION OF DAN DANCIGER ROAD AND
OLD GRANBURY ROAD, AS SHOWN ON PLAT RECORDED IN VOLUME
388-43, PAGE 98, PLAT RECORDS, TARRANT COUNTY, TEXAS; PRO-
VIDING FOR RETENTION OF EASEMENT FOR EXISTING UTILITIES;
PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE temporary road easement and permanent sanitary sewer
easement located in the westernmost -portion of Tract "B", Block
115--R, Wedgwood Addition, adjacent to the rights-of-way and inter-
section of Dan Danciger Road and Old Cranbury Road, as shown on plat
recorded in Volume 388-43, Page 98, Plat Records, Tarrant County,
Texas be and the same are vacated, abandoned, and permanently closed
and extinguished as a temporary road easement and permanent sanitary
sewer easement, respectively.
SECTION 2.
That the fee to the lands in the above described vacated tempo-
rary road easement and permanent sanitary sewer easement is hereby
released and shall revert to the adjacent owners as provided by law,
SAVE AND EXCEPT that easements are retained for any and all existing
utilities located therein, including the existing sanitary sewer
`~ facility.
~ SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Background
Billy R. Delp and Leona Glass Rea, owners of all abutting property, have
requested that the City vacate a triangular shaped temporary road easement and
permanent sanitary sewer easement located adjacent to both the rights-of-way and'
the intersection of Dan Danciger Road and Old Grandbury Road, within the
westernmost port of Tract "B", Block 115-R, Wedgwood Addition, as recorded in
Volume 388-43, Page 98, P.R.T.C.T., as shown on the attached map.
The subject temporary road and permanent sanitary easements, acquired by
dedication, are platted; also, there is an existing sanitary sewer facility which
traverses the southernmost portion of the subject easement area. The vacation
request is made in order to replat the vacated easement areas with adjacent
property, thus expanding the building area and providing more yard space.
The City Water Department indicates that an easement also be retained for the
existing sanitary sewer, located within the easement area. Further, the Real
Property Department has stated that the rights and interests of the City in that
portion of the utility easement denoted in this request have no significant
monetary facilities. Other reviewing City Departments and private utility
companies have raised no objections to this requested vacation of easements. A
satisfactory replat has been submitted.
Recommendation
It is recommended that the City Council adopt an Ordinance vacating the
above-described temporary road and permanent sanitary sewer easements, located
within the boundaries of the Wedgwood Addition, Block 115-R, Tract "B".
