HomeMy WebLinkAboutOrdinance 9454 I 4 _-~' • l~ ~Y Yf f^i ORDI NANC E' NO . / 7 ~7 AN ORDINANCE AMENDING APPENDIX G, "SIGN CODE" OF THE CODE OF THE CITY OF FORT WORTH (1 964) , AS AMENDED, BY INCREAS- ING SIGN INSPECTION FEES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES; PROVIDING FOR THE REPEAL OF ALL ORDINANCES AND PROVISIONS IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR THE ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE; AND DE- CLARING AN EFFECTIVE DATE. a BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Appendix G of the Code of the City of Fort Worth, Texas (1964), as amended, is hereby further amended by amending Sec- t ion 3.0 4 thereof to read and be as follows "Section 3.04. A sign inspection fee, calculated pursuant to the -schedule specified in Table 3-A, shall be paid by each applicant for such sign permit prior to the issuance of any such permit. Such fee shall include all costs of inspection incurred by the City as a result of the appli.- cation for such sign permit. Table 3-A. Sign Inspection Fees 0-200 .201-600 601+ sq. ft. sq. ft. sq. ft. Th i s ordinance shal l be cumul at ive of al i prov is-ions of ord i- nances and of the Code of the City of Fort Worth, Texas (1964), as a -~ .., .~ - . a .- amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconsti- tutional by the valid j udgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and Sections 1 and 5 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained . Background. The City contracted with David M. Griffith and Associates, Ltd, in November 1982 to conduct a City-wide analysis of user fees and service charges. This process proved to be beneficial in identifying the actual costs of providing services and and comparing these costs with the amount of revenue collected as payment for these services. The City used the results of this study to adjust fee schedules so that a specified percentage of costs could be recovered. In Play, 1983, (M&C G-5621), the City Council adjusted more than one hundred fees. In November 1983, the City entered into a three-year contract with David M. Griffith and Associates, Ltd. to update this City-wide user fee study. Each year, program costs and estimated revenue from user fees are analyzed to determine if the City is maintaining its cost recovery percentages that were established in 1982-83. For those services where revenue generation is not keeping pace with actual costs, fee adjustments are recommended. Prior to presenting these recommendations to the City Council for approval, all affected departments were consulted for guidance and assistance in developing these proposed fee adjustments.
