ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OP BIDDISON STREET
AND PORTIONS OF SUNDRY OTHE#t STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OP PORT WORTH, TEXAS9 DECLARING THE CONTRACT WITH
APAC-TEXAS, INC. POR THE CONSTRUCTION OF
SAID IMPROVEMENTS FULLY COMPLETED AND PERPORMEDg DIRECTING THE
ISSUANCE, EXECUTION AND DELIi~ERY OP CERTIFICATES IN EVIDENCE OP
SPECIAL ASSESSMENTS LEVIED AFTER GYVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OP SAID ASSESSMENTS;
DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE
BY COPYING THE CAPTION OP SAME IN TF#E MINUTE BOOK OP THE CITY
COUNCIL OF FORT WORTH, TEXAS, AND BY PILING THE COMPLETE ORDINANCE
IN APPROPRIATE ORDINANCE RECO1tDS OP SAID CYTYg AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Port Worth, Texas, has heretofore entered into a contract
with _ APAC Texas, Inc. , for the mateing and construction of
certain street improvements on the hereinafter described portions of streets, avenues and
public places in said City, tom~iita
BIDDISON STREET From McCart Avenue to Hemphill Street, known and designated
as Project No. 021-025233., a six-inch thick hot-mix asphaltic
concrete pavement with. seven-inch. high concrete curb and
eighteen-inch wide concrete gutter on an eight-inch thick
cement stabilized crushed stone base, so that the finished ~l
roadway will be thirty-six feet wide. Six-inch thick concrete
driveway approaches will be constructed where specified and
five-feet wide concrete sidewalk will be constructed adjacent
to the south side of the street only.

LvHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 8863 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
hiHEiiI;AS, the City Council of the City of Fort ~'tiorth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 8863 , and

upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefore

BE IN ORDAIIJED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:

The improvements on each of the portions of streets, avenues and publio
places hereinabove described be, and they are hercby, accepted, and the contract with
reference thereto be, and it is hereby, found and declared fully completed and perforrrned.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance t~rith
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon, The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after diving
effect to such credit, if arty, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price,
IV.
The Cfty Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas
and by filing the complete ordinance in the appropriate Ordinance Reeords of said City.
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passagee

PROJECT N0. 021-025233-00, BIDDISON STREET FROM McCART AVENUE TO HEMQHILL STREET, to be improved with
six thick hot-wix asphaltic concrete pavement with seven-inch high concrete curb and eighteen-inch wide
concrete gutter on an eight-inch thick cement stabilized crushed stone .base, so that the finished
roadway will be thirty-six feet wide. Six-inch thick concrete driveway approaches will be constructed

Deviation from Bid Price
Final measured quantities at contract unit prices yield an earned total price
for this contract of $665,455.65 which is $39,417.67 (6.29%) over the bid
price. Several factors contributed to the overrun, but the main cause was the
addition of 450 linear feet of reinforced concrete retaining wall which had not
been included as a pay item by the consultant. The retaining walls were neces-
sary at four separate locations to prevent the parkway from washing down into
the street. In addition, some of the quantities contained in the bid proposal
were not adequate to complete the project according to the plans. An additional
480 C.Y. of crushed limestone, 972 S.Y. of HMAC surface, 405 S.F. of reinforced
concrete driveway, 2047 S.F. of reinforced concrete sidewalk, and 353 L.F. of
curb and gutter were necessary beyond the original quantities.

Financing
Final payment is to be made fro m Project No. 21-025233-00. A bond fund transfer
in the amount of $39,500.00 will be necessary to finance the project.
Compliance with Specifications
The project has been completed in accordance with the requirements of the con-
tract.
Recommendation
It is recommended that the City Council•
