AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A PORTION OF THE 300 BLOCK OF EAST SECOND STREET, A PUBLIC STREET RIGHT-OF-WAY OF VARIABLE WIDTH, FROM CALHOUN STREET EAST TO JONES STREET; PROVIDING FOR REVER- SION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CON- --.F,LICT .HERE.WITH.;. AND P..ROVID.ING.. AN..EF.FECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. s That a portion of the 300 block of East Second Street, a public street right-of-way of variable width, from Calhoun Street to Jones Street, said portion of East Second Street being more particularly described in Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished as a public street right-of-way. SECTION 2. That the fee to the land in the above described vacated public street right-of-way is hereby released and shall revert to the adj a- cent owner as provided by law, SAVE AND EXCEPT that easements are retained for any ands all existing. and prospective utilities and w:. drainage facilities. ~ *~ ` SECTION,,: 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. Recommendation It is recommended that the City Council adopt the attached ordinance vacating a portion of the 300 block of East Second Street, a variable width right-of-way, from Calhoun Street east 200 feet to Jones Street, as recommended by the City Plan Commission. Discuss ion City Center Development Company, owner of the abutting property, has requested that the ('ity vacate a portion, of the 300 block of East Second Street, a variable width (9.29' at Calhoun Street and 60' at Jones Street) right-of-way, from Calhoun Street east 200' to Jones Street, as shown on the attached map. The sub- ject street right-of-way, acquired by dedication, is open on the ground, improved, and contains water, sewer, electric and gas utility facilities. The subject request is made in order to replat the vacated right-of-way with adjacent property, thus expanding the building area and providing more usable yard space. The required and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objec- tions to this request, subject to the vacated right-of-way being replatted with adjacent property, the vacated right-of-way being physically closed with standard curb and gutter at Calhoun Street and Jones Street, unless standard driveway approaches are approved and constructed, and the vacated right-of-way being re- tained as a drainage and utility easement for existing drainage and utility faci- lities, unless other satisfactory arrangements are made. A satisfactory replat has been submitted. The City Plan Commission has reviewed this request and recommends that the sub- ject portion of street right-of-way be vacated as requested.
