HomeMy WebLinkAboutOrdinance 9365 ~.~ 1 ~ r1, N• ~ I' `~' ORDINANCE N0. ~~`~„ r~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING THE 10 FOOT WIDE UTILITY EASEMENT LOCATED ALONG THE NORTH LINE AND WITHIN LOT A, BLOCK 88, WESTERN HILLS ADDITION, SECTION 7, AS SHOWN ON PLAT RECORDED IN VOLUME 388-48, PAGE 641, DEED RECORDS, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE 10 foot wide utility easement located along the north line and within Lot A, Block 88, Western Hills Addition, Section 7, as shown on plat recorded in Volume 388-48, Page 641, Deed Records, Tarrant County, Texas, and being more particularly described in Exhibit "A", said Exhibit being attached hereto and incorporated herein, be and the same is vacated, abandoned, and permanently closed and extinguished as a public utility easement. SECTION 2. That the fee to the land in the above described vacated public utility easement is hereby, released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Muckl er. oy, Jr. , on behalf of Highway 8D Joint Venture, owner of al 1 abutting property, has requested that the City vacate a 10' wide utility easement located along the north line and within Lot "A", Block 88, Western Hills Addi- tion, Section 7, extending westward from Portal es Drive a distance of 185' to the northeast corner of said Lot "A", as recorded in Volume 388-48, Page 641, D.R.T.C.T.., as shown on the attached map. The subject utility easement, acquired by dedication, contains no utility facili- ties. The subject request has been made in order to expand the building area and provide more usable yard space. Necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objec- tions to this request. Recommendation It is recommended that the City Council adopt an ordinance vacating the 10' wide utility easement located within and along the north line of Lot "A", Block 88, Western Hills Addition, Section 7.
