HomeMy WebLinkAboutOrdinance 18002-03-2008ORDINANCE NO. 18002-03-2008 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF CARLOCK AVENUE BETWEEN SOUTH COLLEGE AVETf(TE AND WASHINGTON STREET, IN THE CITY OF FORT WORTH, TA~I2ItANT COUNTY, TEXAS; BEING 135 FEET LONG BY 25 FEET WIDE, CONTAINING APPROXIMATELY 0.08 ACRE OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Oarlock Avenue, 135 feet long by 25 feet wide, as indicated on the Plat of Oarlocks South Side Addition an addition in the City of Fort Worth, Texas as shown on the Plat thereof recorded in Volume 106 Page 108 of the Plat Records of Tarrant County, located between South College Avenue and Washington Street, containing approximately 3,375 square feet or 0.08 acre of land, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. 1 All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Worth Tarrant County, Texas and being a part of Cariock Avenue as indicated on the Plat of Cartocks South Side Addition an addition in the City of Ft. Worth, Texas as shown on the Pfat thereof recorded in Volume 106 Page 108 Plat Records of Tarrant County, Texas; the subject tract being more particularly described as follows; BEGINNING fior the Northeast corner of the tract being described herein at a capped iron rod set for the Southeast comer of Lot 13 in Block 1, said Cartocks South Side Addition and being the Northeast terminus of Cariock Avenue as shown on said Plat and being on the West line of College Avenue; THENCE South along said College Avenue a~ distance of 25.00 feet to an "x° set in :: a concrete fence runner for the Southeast corner of said Garbck Avenue at the apparent Northeast comer of that certain tract described in the deed to Glenn Conner et.ux. recorded in Volume 11798 Page 2180 Deed Records Tarrant County, Texas; THENGE South 89 degrees 45 minutes 40 seconds West with the South line of said Cariock Avenue along said fence runner a distance of 135.00 feet to an "x" set for the Southwest comer of the herein described tract; THENCE North crossing said Cariock Avenue a distance of 25A0 feet to a capped iron rod set for the Southwest corner of said Lot 13 on the North line of said Garlock Avenue; THENCE East with the North fine thereof and South line of said Lot 13 a distance of 135.00 feet to the PLACE OF BEGINNING and enclosing 0.08 of an acre of land more or less. No. # 18002-03-2008 DATE: Tuesday, March 04, 2008 LOG NAME: 06VA-07-013 REFERENCE NO.: PZ-2775 SUBJECT: Adopt an Ordinance Vacating a Portion of Carlock Avenue, 135 Feet Long by 25 Feet Wide, Containing Approximately 3,375 Square Feet, between South College Avenue and Washington Street, in the City of Fort Worth, Tarrant County, Texas, and Waive Purchase Fees RECOMMENDATION: It is recommended that the City Council: 1. Adopt an ordinance vacating a portion of Carlock Avenue, 135 feet long by 25 feet wide and containing approximately 3,375 square feet, between College Avenue and Washington Street, adjacent to Lot 13, Block 1, Oarlock's South Side Addition, City of Fort Worth, Tarrant County, Texas; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624). DISCUSSION: KAZ Surveying, on behalf of David Wilson, Jr., has requested to vacate the above referenced right-of-way and to replat and incorporate it within the adjoining property in hopes of providing better security far his home. By vacating this section of right-of-way he will be able to fence it off and prevent future criminal activity. The City Plan Commission recommended approval of this request at its meeting on July 25, 2007. An acceptable replat (FS-07-240) has been received. Any existing utilities will be relocated at the applicant's expense, or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon. The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process. The City does not own land under, or adjacent to, the above referenced right-of-way. Since no City funds have been expended to purchase property or easement rights, collection of the fee value or any portion thereof is recommended by staff to be waived. This request is located in COUNCIL DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
