ABANDONING AND CLOSING AND EXT'IN- GUISH.ING A PORTION OF AN ALLEY COMPRISING PART OF AND LYING WITHIN BLOCK 64, MORGAN HEIGHTS, W. A. ARCHER'S ADDITION TO THE. CITY OF -FORT WORTH; PROVIDING FOR REVER- SION OF FEE IN SAID LAND; RE.P.EALING ALL ORDINANCES IN CON- FLICT HEREWITH; AND PROVLDING AN .EF.FECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF' FORT WORTH, TEXAS; SECTION 1. ., That the portion of an alley comprising part of and~ Tying with- in Block 64, Morgan Heights, W. A. Archer's Addition to the City of Fort Worth, Tarrant County, Texas, and lying adjacent to and contig- uous with Lots ~~6, 7,, 8, 9, 1U, 11, 12 and 13 of said Block 64, said vacated portion being 15 feet in width and 183 feet in length from the south boundary of Lots 9 and 10, Block 64, to the north boundary of Lots 6 -and 13, Block 64, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the lands in the above described vacated public alley and right-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and all appurtenances thereto and improvements associated therewith. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed.. SECTION 4. ARCHER'S ADDITION (MORGAN '°r OC , ~ S - (V-85-11 ) RECOPIMENDATION It is recommended that the City Council adopt an Ordinance vacating a 183' x 15' section of a north/south alley northward from N.E. 28th Street to the north line of Lot 6, Rlock 64, W.A. Archer's Addition (Morgan Heights Addition), as recommended by the City Plan Commission. DISCUSSION Larry Sanders, with consent of all other abutting property owners, has requested that the City vacate the 15' wide south portion of the north/south alley described above and as shown on the attached map. The subject alley right-of-way, acquired by dedicai;ion, is not open on the ground and there are no curb cuts, however, electrical and telephone utility facilities are located within the said alley right-of-way and easements must be retained, unless other satisfactory arrangements are made with the responsible utility companies. The necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objections to this request, subject to the vacated right-of-way being replatted with adjacent property, such replat to include assurance of physical access to all individual lots, and the vacated right-of-way being retained as a utility easement for existing and any other required utility facilities, unless other satisfactory arrangements are made. A satisfactory replat, dedicating the required utility easements and alley access, has been submitted. The City Plan Commission has reviewed this request and recommends that the subject portion of alley right-of-way be vacated as requested. DAI gbgq SUBMITTED FOR THE ?
