ORDINANCE N0. _~~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING CERTAIN EMERGENCY ACCESS, UTILITY AND PUBLIC OPEN
SPACE EASEMENTS COMPR.ISLNG PART OF AND LYING WITHIN THE
EASTPOINTE' ADDITION TO THE CITY OF FORT WORTH, SAID EASE-
MENTS BEING MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING
FOR REVERSION OF FEE IN SAID .LANDS; REPEALING ALL ORDI-
NANCES IN CONFLICT HEREWITH; .AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That" the emergency access, utility and public open space ease-
ments comprising part of and lying within the Eastpointe' Addition
to the City of Fort Worth, Tarrant County, Texas, and being. more
specifically ,described or depicted in Exhibits "A" and "B" attached
hereto and incorporated herein by reference for all purposes, be and
the same are. vacated, abandoned and permanently closed and extin-
guished.
SECTION 2.
That all ordinances or parts of ordinances in conflict herewith
ark. hereby repealed .
SECTION 3.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained .

Being the abandonment of various easements designated as 26' emergency access
and utility easements, public open space easements, 10' and 15' utility easements,
and water service easements within Lots I-3, Block 2, Eastpointe' Addition as
recorded in Volume 388-172, Page 32, Deed Records, Tarrant County, Texas,
situated in the William Mann Survey, Abstract No. 995, Tarrant County, Texas,
being more particularly described as follows:
Being the abandonment of 4 private streets (Eastpoin#e' Centre Drive, Easepointe'
Drive North, Eastpointe' Drive South, and Eastpointe' Centre Circle) designated as
26' emergency access and utility easements with public open space easements,
more particularly described as:
BEGINNING South 88 degrees 53 minutes 20 seconds East along the south line of
John T. White Road 381.00 feet from the intersection of the south line of John T.
White Road and the east line of Anderson Boulevard, said point also being the
northwest corner of Lot I, Block 2 of said Eastpointe Addition:

RECOP1PIENDATION
It is recommended that the City Council adopt an Ordinance vacating the following
easements
(1) Eastpointe' Centre Drive, a 26' wide. emergency access and utility easement,
from John T. bJhite Road southward to Eastpointe' Drive South (a 26' wide
emergency access and utility easement),
(2) Eastpointe' Drive North, a 26' wide emergency access and utility easement,
from Anderson Boulevard southeast and east to Eastpointe' Centre Drive,
(3) Eastpointe' Drive South, a 26' wide emergency access and utility eaesment,
from Anderson Boulevard east to Eastpointe' Centre Circle;
(4) Eastpointe' Centre Circle, a 26' wide emergency access and utility
easement, from Anderson Boulevard east, northeast, north and west to
Eastpointe' Centre Drive,
(5) The 10 20' x ?_0' public open space easements associated with the
aforementioned 26' wide emer.yency access easements and 15',wide utility
easement and their intersections with John T. White Road and Anderson
Boulevard,
(6) The ?5' x 15' utility easement adjacent to the north right-of-way line of
Eastpointe' Drive North,
(7) The 10' x 5' utility easement adjacent to the south right-of-way of
Eastpointe' Drive North,
(8) The 15' wide utility easement between Eastpointe' Centre Drive and
Eastpointe' Centre Circle,
(9) The 15' x 23' utility easement, the 10' x 25' utility easement, the 10' x
3(-' Kati 1 i ty easement , the 10' x 15' uti 1 i ty easement , and two 10' x 10'
utility easements adjacent to the southeast, east right-of-way line of
Eastpointe' Centre Circle;
(10) Three 10' wide utility easements located parallel and collinear with the
common property lines of Lots 1, 2 & 3, Block 2, Eastpointe' Addition, as
recorded in Volume 38R-172, Paye 32, P.R.T.C.T., all as shown on the
attached map.

DISCUSSION
Barry }iudson, agent for The Braxton Company, owner of all abutting property, has
requested that the City vacate the above-described easements, as shown on the
attached map.
he subject emergency access and utility easements, public open space easements,
nd utility easements were acquired by dedication, and are platted but contain no
tility facilities.
The subject vacation request is made in order to replat the vacated easements and
rights-of-ways with abutting property, thus expanding the building area and
providing more usable yard space.
t is the opinion of the Real Property Department that the rights and interest of
he City in the subject emergency access, open space and utility easements
escribed in this request have no monetary value, if vacated.
viewing City departments and private utility companies have raised no
jections to this request, subject to the vacated rights-of-way being replotted
th adjacent property. A satisfactory replat has been submitted.
