AN ORDINANCE AMENDLNG CHAPTER 29A (POLICE) OF THE CODE OF
THE CITY OF FORT WORTH (1964), AS AMENDED, BY REVISING
ARTICLE III, SECTION 29A-12(E), TO PERMIT THE CITY OF FORT
WORTH TO AGREE NOT TQ REQUEST REIMBURSEMENT FOR LAW EN-
FORCEMENT SERVICES RENDERED TO A JOINT AIRPORT PURSUANT TO
AN INTERLOCAL ASSISTANCE AGREEMENT; PROVIDING FOR THE
REPEAL OF ALL ORDINANCES AND PROVISIONS IN CONFLICT HERE-
WITH AND MAKING THIS ORDINANCE CUMULATIVE OF' PRIOR ORDI-
NANCES NOT IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE;
AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Chapter 29A (Police)., Article III of the Code of the City
of Fort Worth (1964), as amended,, is hereby amended by changing
Section 29A-12(e) to read as follows:
"(e ) Unless otherwise expressly agreed to by the
City of Fort Worth pursuant to a law en-
forcement interlocal assistance agreement
duly executed by the City of Fort Worth and
other counties or municipalities, or a
joint airport., as defined in Article 999b,
V.A.C.S., all. wages and pension payments,
payments for damage to equipment and cloth-
ing, medical expenses and expenses of
travel, food and lodging shall be paid by
the City of Fort Worth and shall be reim-
bursed by the county, municipality or joint
airport whose authorized official requested
the services."
SECTION 2.
This ordinance shall repeal every prior ordinance and provision
of the Code of the City of Fort Worth in conflict herewith but only
insofar as any portion of such prior ordinance or provision shall be
in :conflict, and, as to all other ordinances or provisions of the
Code of the City of Fort Worth not in direct conflict herewith, this
ordinance shall be and is hereby made cumulative.
SECTION 3_

It is hereby declared to be the intention of -the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-

tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
This ordinance shall be in full force and effect from and after
the date of i.ts passage.

It is recommended that the City Council:
1 adopt the attached ordinance amending Chapter 29 A (Police), Article
III, of the City Code of the City of Fort Worth (1964), as amended,
changing Section 29 A-12(e); and,
2 authorize the Dallas-Fort Worth International Airport to become a
member of the Regional Law Enforcement Task Force; and
3 authorize the City Manager to execute a Law Enforcement Interlocal
Assistance Agreement, and any and all other documents, necessary for
D-FW Airport to become a member of the task force
On February 7, 1984 (M&C C-8206), the City Council authorized the City
Manager to execute the Greater Dallas-Fort Worth Regional Law Enforcement
Interlocal Assistance Agreement. The agreement establishes a formalized
interlocal law enforcement assistance group to be entitled the Greater
Dallas-Fort Worth Regional Law Enforcement Task Force
C According to the agreement, "the purpose of the task force is to cooperate
in the investigation of criminal activity and enforcement of the laws
of the state, and to assist in providing additional law enforcement officers
to protect health, life and property against riot, unlawful assembly
characterized by the use of force and violence, and during times of natural
disasters of man-made calamity."
A member of the task force may request assistance from another member
agency, and the request shall include the number of personnel needed,
type of equipment required and the location where the assistance is needed.
The level of response provided is subject to the discretion of the chief
law enforcement officer of the responding agency. The officers responding
to a request shall be under the command of the requesting agency and shall
have all the powers of a regular law enforcement officer of that
jurisdiction. Officers responding to a request for assistance shall receive
the same salary and benefits they regularly receive from the agency they
are employed by.
At the 1985 regular session, the Texas Legislature adopted S.B. 35 which
authorizes the participation of joint airports in law enforcement interlocal
assistance agreements with municipalities. The Dallas-Fort Worth
International Airport has requested permission to execute the interlocal
agreement and to become a member of the Greater Dallas-Fort Worth Regional
Law Enforcement Task Force. In order for D/FW Airport to participate

in the task force, it will be necessary to amend Chapter 29 A (Police),
Article III of the Cfty Code of Fort Worth (1964), as amended., to change
Section 29 A-12(e) to indicate that the City of Fort Worth is authorized
to execute the inter local agreement with a joint airport
