AMENDMENT No.2
to CITY SECRETARY CONTRACT No. 43928
WHEREAS, the City of Fort Worth (CITY) and Gary P. Kutilek d/b/a The
Landscape Alliance (ENGINEER) , made and entered into City Secretary Contract No.
43928 (the CONTRACT) , which was authorized by M&C C-25888 on the 25 day of
September, 2012, in the amount of $ 188, 790. 00; and
WHEREAS the CONTRACT involves engineering services for the following
project:
Park Improvements at Northwest Community Park; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in
the amount of $17, 025. 00, which was executed administratively on October 7th,
2014, for the following project:
WHEREAS, it has now become necessary to execute administratively Amendment
No. 2 to the CONTRACT to increase the scope of work and revise the fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
CONTRACT:

Article I of the CONTRACT is amended to include the additional engineering
services specified in a proposal dated February 11, 2016, a copy of which is
attached hereto and incorporated herein. The cost to CITY for the additional
design services to be performed by ENGINEER totals $36, 225. 00. (See Attached
Funding Breakdown Sheet, Page -3- )

Article II of the CONTRACT is amended to provide for an increase in the fee
to be paid to ENGINEER for all work and services performed under the CONTRACT,
as amended, so that the total fee paid by CITY for all work and services shall
be an amount of $242, 040. 00.

All other provisions of the CONTRACT, which are not expressly amended
herein, shall remain in full force and effect.

Additional Services for Submission to Texas Commission on Environmental Quality
Dear Bryan:
As we have previously discussed, a required submittal of close out documents to TCEQ, regarding the
recently completed dam repairs, may initiate water rights permitting. We are recommending a
preemptive course of action in order to avoid or mitigate this probable requirement. In this regard we
have contacted water right experts, to serve as sub-consultants to our existing contract. Upon approval of
this amendment, we will coordinate necessary data collection, a pre-permit meeting, and then present
this matter to TCEQ for their consideration.
Scope of Work
To improve support for a `no water rights' permit position the following items should be prepared for
submittal to TCEQ;
1. Bathymetric Survey on Lake Loughridge.
2. Determine the storage capacity of and prepare an area/elevation capacity curve for Lake
Loughridge.
3. Run the TCEQ's Water Availability Model (WAM) to show that Lake Loughridge has little to
no impact on overall water availability in the state.
4. Request a letter of `no contest' from Tarrant Regional Water District (TRWD) and the Trinity
River Authority (TRA) in regards to Lake Loughridge.
The Wallace Group a (CP&Y company) will perform the field work and prepare the bathymetric survey.
The bathymetric survey will be utilized to determine the storage capacity and prepare the area/elevation
capacity curve for the lake. From this data preparation of the WAM will be made. We will contact
TWRD and TRA to formulate letters in support of the `no water rights' permit position.
After we have gathered and reviewed the data in support of the TCEQ submittal, we will set a meeting
with TCEQ staff to present for a variance from the water rights permit requirement. In the event that
TCEQ does not grant the requested variance,the WAM and all other information gathered for the scope
of this proposal can be utilized in the subsequent preparation of a water rights permit application. Any

resulting permitting requirements will be addressed by separate agreement. The Terms and Conditions
for the additional services are the same as those included in our original agreement.
Fees
We propose to provide the above referenced services on a time and material basis with a not to exceed
fee of$36,225.00 and as follows:

Total Additional Fee.................................... $ 36,225.00
