AND PORTIONS OF SUNDRY OTHE~t STREETS, AVENUES AND PUBLIC PLACES IN TY3E CITY OF FORT WORTH, TEXAS9 DECLARING TIC CONTRACT WITH CHARLES COHEN, INC. & TEXAS BITULITHIC FOR THE CONSTRUCTION OF SAID YMPROVEMENTS FULLY COMPLETED AND PERFORMEDe DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GYVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THYS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOR OF THE CITY COUNCIL OF FORT WORTHY TEXASa AND BY FILING THE COMPLETE ORDINANCE YN APPROPRIATE ORDINANCE RECORDS OF SAYD CITYg AND PROVIDING AN EFFECTIVE DATE. WHEREASa the City of Fort Worthy Texasa has heretofore entered into a contract wrath Charles Cohen, Inc. & Texas Bitulithic Co. a for the making and construction of certain street improvements on the hereinafter described portions of streetsp avenues and public places in said Cityp tom~iit: TRINITY BOULEVARD From F.M.-157 to Euless South Main Street, known and designated as Project No. 030-036720-00. A seven-inch thick reinforced concrete pavement with seven-inch high monolithic concrete curb on a six-inch thick lime stabilized subgrade, so that the fin- ished roadway will consist of two thirty-six feet wide traffic lanes with a twenty-eight feet wide median. Seven inch thick reinforced concrete turn lanes and median openings will be constructed where specified. 1 ~~~HEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort 1Jorth, Texas, including Ordinance No, 9059 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, wHE~DAS, the City Council of the City of Fort ~'+orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No, 9059 ,and 1rdHEfiEAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance Vrith the contract therefor; NUbu, TtH;~t~.F'OHI,, BE IN ORDAINED BY THE CITY COUNCIL OF' THE CITY OF FORT WORTH, TEXr~S, THAT Ie The improvements on each of t ho portions of streets, avenues and publio places hereinabove described be, and they are hereby, accepted, and the contract with reference thereto be, and it is hereby, found and declared fully completed and perfornned, IIe The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance Urith the proceedings relating to such improvements and assessmentso The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereone The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after diving effect to such credit, if arty, are hereby enumerated and itemized as follows: III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract pricey IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City, V. This ordinance shall take effect and be in full force and effect from and after the date of its passage.
