ORDINANCE NO.
AN ORDINANCE INCREASING BY $400,000 THE ESTIMATED REVENUES
ACCRUING TO THE GENERAL FUND OF THE CITY OF FORT WORTH FOR
THE FISCAL YEAR 1984, AND APPROPRIATING FROM THE INCREASED
ESTIMATED REVENUES OF THE GENERAL FUND THE SUM OF' $400r000
TO THE GENERAL FUND ACCOUNT NO. 13-40-01, TAX ADMINISTRA-
TION, INDEX CODE 011130, DELINQUENT TAXES, FOR PAYMENT OF
COLLECTION FEES; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PRO-
VIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the estimated revenues accruing to the General Fund of the
City of Fort Worth for the Fiscal Year 1984 are hereby increased by
$400,000; and that there shall be appropriated, from the increased
estimated revenues of the general fund the sum of $400,000 to the
General Fund Account No. 13-40-01, Tax Administration, Index Code
011130, Delinquent Taxes, to fund the payment of collection fees to
Heard, Goggin & Blair, Taylor Gandy and H.G. Wells for Fiscal Year
1984.
SECTION 2.
That should any portion, section or part of a section of this
ordinance be declared invalid, inoperative or void for any reason by
a court of competent jurisdiction, such decision, opinion or judg-
ment shall in no way impair the remaining portions, sections or
parts of sections of this ordinance, which said remaining provisions
shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of all other ordinances
and appropriations except in those instances where the provisions of
this ordinance are in direct conflict with such other ordinances and
appropriations, in which instances said conflicting provisions are
hereby expressly repealed.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and

effective date of same in the minutes of the City Council of the
City of Fort Worth and by filing this ordinance in the ordinance
records of said City.
SECTION 5.
That this ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Background
On October 23, 1984 (Informal Report No 6979) the City Manager advised Council
of his intention to request proposals to collect delinquent tax, paving, weed
and demolition lien accounts for the City of Fort Worth. A Request for
Proposals was issued on October 26, 1984, and proposals were received from
three law firms. Two firms made oral presentations to a City Council Committee
on December 7, 1984 On December 11, 1984, the Committee recommended that
the proposal of Heard, Goggan & Blair, Taylor Gandy and H G Wells be accepted
and Council directed that a contract be prepared and placed on the agenda
for consideration
Summary of Proposal
Heard, Goggan & Blair, Taylor Gandy and H G Wells have made the following
proposal
1. The £irm will collect delinquent taxes for the City of Fort Worth
and Fort Worth Independent School District for a fee of 15 percent
of the delinquent taxes, penalty and interest actually paid to the
City Tax Collector during calendar year 1985. The firm guarantees
that the amount of delinquent taxes, penalty and interest collected
during calendar year 1985 will be at least $2,600,000. The firm
further guarantees in calendar year 1985 to collect at least 150
percent of the amount of delinquent taxes, penalty and interest
collected during calendar year 1984 or to reduce its fee to 10 percent
of taxes, penalty and interest collected in 1985.
2. The firm will collect paving, weed and demolition liens at no cost
to the City, except attorney's fees to be paid by the debtors.
3. The firm will bear the entire cost of the collection operation,
including salaries, computer costs, rent, equipment, materials,
telephone, postage and related matters including title reports- and
data processing services.

appropriations ordinance be adopted.

engaging Heard, Goggan & Blair, Taylor Gandy and H G. Wells to perform
collection services for the City for one year with an option for
the City to renew the contract for two subsequent one-year periods
under the same terms and conditions
2 The Council ad opt the attached supplemental appropriations ordinance
appropriating $400,000 to General Fund Account 13-40-01, Tax
Administration for increased Estimated Revenues in Index Code 011130,
