AN ORDINANCE AMENDING APPENDIX B, "PERSONNEL", OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1964), AS AMENDED, PRO- VIDING FOR THE PAYMENT OF ASSIGNMENT PAY FOR PERFORMANCE OF SPECIALIZED FUNCTIONS WITHIN THE POLICE AND FIRE DEPARTMENTS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THTS ORDINANCE; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That Appendix B, "Personnel", of the Code of the City of Fort Worth, Texas (1964), as amended, be and is hereby further amended by adding a new Chapter II, and the said chapter shall read as follows: "CHAPTER II. ASSIGNMENT PAY. Sec. 1. Assignment. Pay for performance of specialized functions with the police department. a. The police chief may designate one officer from the classification immediately below that of police chief, who, in addition to that officer's regular duties, will be assigned the duties of executive deputy chief, and who will perform the following specialized functions with the department: 1) Serve as acting police chief when the police chief is absent from the city or is temporarily unable to fulfill the duties of the office of police chief; 2) Represent police department in matters pertain- ing to budget, personnel., Legal and administrative matters; 3) Represent police chief at public functions; when police chief is unable to attend; 4) Assist police chief in evaluation of departmen- tal employees and performance; 5 ) Assist police chief in inter-city and infra-city agency and department relations; 6) Performs other specialized duties, as assigned by the police chief . b. The officer who performs the above specialized func- tions shall receive the sum of ~a 7arD--° dollars per month as assignment pay. The fire chief may designate one officer from the classification immediately below that of fire chief, who, in addition to that officer's regular duties, will be assigned the duties of executive deputy chief, and who will perform the following specialized functions with the department: 1) Serve as acting fire chief when the fire chief is absent from the city or is temporarily unable to fulfill the duties of the office of fire. chief; 2) Represent fire department in matters pertaining to budget, personnel, legal and administrative mat- ters; 3) Represent fire chief at public functions; when fire chief is unable to attend; 4) Assist fire chief in evaluation of departmental employees and performance; 5) Assist fire chief in inter-city and antra-city agency and department relations; 6) Performs other specialized duties, as assigned by the fire chief. b. This ordinance shall be cumulative of all provisions of order nances and of the Code of the City of Fort Worth, Texas (1964), as amended, except where the provisions of this ordinance are in diredt conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Cov!~~il that the sections, paragraphs, sentences, clauses and phrasea Gf this ordinance are severable, and if any phrase, clause, senten~~, paragraph or section of this ordinance shall be declared unconsti~a*-= tional by the valid judgment or decree of any court of apetent jurisdiction, such unconstitutionality shall not af-f ct any of the remaining phrases, clauses, sentences, paragraphs ~tncl sections of -2- .,.~' '' A_ ~,, r ib ,~,~. • this ordinance, since the same. would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. The amount of assignment pay and the criteria for payment of assignment pay must be established by ordinance and is in addition to the fire fighters' and police officer's regular pay. Such an ordinance may set criteria that provides for payment only to a fire fighter or police officer in a special assignment. At the request of the Fire and Police Chiefs, an ordinance establishing assignment pay for performance of specialized functions within the police and fire departments has been prepared by the Department of Law for City Council consideration; the ordinance has been reviewed by the Personnel Department and City Manager's Office. Initially, the only positions being recommended for assignment pay are the "executive deputy chiefs" of the Police and Fire Departments. The attached ordinance permits the Police and Fire Chief to designate one officer from the classification immediately below that of chief, who in addition to that officer's regular duties, will be assigned the duties of "executive deputy chief" in their respective department. Informal Report No. 6990 outlines the specialized functions of "executive deputy chief" in the Police and Fire Departments, which are the positions being recommended to receive assignment pay. The officers designated as "executive deputy chief" shall receive the sum of $275 per month or $3300 per year as assignment pay. Financing: Funding is available in Police Department AccountNo.35-20-00, index code 260539, and Fire Department Account No.36-10-00, index code 275040. No additional appropriation is required.
