HARRISON SURVEY, NORTHWARD TO STAIR ROAD; VACATING, ABANDONING, AND CLOSING A PORTION OF THE 8400 BLOCK OF STAIR ROAD, EXTENDING EASTWARD FROM RANCH LANE TO THE INTERSECTION OF STAIR ROAD WITH THE EDERVILLE ROAD EXTENSION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following be and the same are vacated, abandoned, and permanently closed as a public street rights-of-way: A. A portion of the 1800 Block of Ranch Lane, from the south line of Tract 2-B, D.C. Harrison Survey, northward to Stair Road; and B. A portion of the 8400 Block of Stair Road, extending eastward from Ranch Lane to the intersection of Stair Road with the Ederville Road Extension; Both of said vacated public street rights-of-way being more particularly described in Exhibit "A", attached hereto and incorporated herein. SECTION 2. That the fee to the lands in the above described vacated public street rights-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Harrison Survey, A-658, 1 Tracts 2-B & 2-C (V-85-1) '°' Background Eastchase Plaza, Ltd., owner of a portion of Tract 2-C, D.C. Harrison Survey, with the written consent of the owner, Dan G. Reaves, of Tract 2-B, D. C. Harrison Survey, has requested that the City vacate that portion of Ranch Lane in the 1800 block from the south line of Tract 2-B,~D. C. Harrison Survey, northward to Stair Road; and to vacate that portion of Stair Road in the 8400 block, ex- tending eastward from Ranch Lane to the intersection of Stair Road-Ederville Road Extension, adjacent to Tract 2-B, D. C. Harrison Survey, all as shown on the attached map. The Ranch Lane right-of-way, established by usage, and the Stair Road right-of- way, designated and established prior to inclusion within the corporate limits, both contain Southwestern Bell facilities, for which a utility easement must be retained. The ends of both streets should also be physically closed, at the south end of Ranch Lane and at the intersection of Stair Road with the Ederville Road Extension. The subject request has been submitted in order to replat the vacated right-of-way with abutting property on both sides to permit additional area for development purposes. It is noted, for clarification, that a previous portion of Stair Road, extending westward from Ranch Lane a distance of approximately 1500' to the realigned por- tion of Brentwood Stair Road, was previously vacated by City Ordinance No. 9191. Reviewing City departments and private utility companies have raised no objec- tions to this request, subject to the vacated right-of-way being replatted with adjoining properties. Satisfactory replats have been submitted. The necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. The City Plan Commission has reviewed this request and recommends that the sub- ject street right-of-way be vacated as requested. Recommendation It is recommended that the City Council adopt an ordinance vacating that portion of Ranch Lane in the 1800 block from the south line of Tract 2-B, D. C. Harrison Survey, Northward to Stair Road; and to vacate that portion of Stair Road - Ederville Road extension, adjacent to Tract 2-B, D. C.
