ORDINANCE N0.
AN ORDINANCE AMENDING CHAPTER 19, "HEALTH AND SANITATION,"
OF THE CODE OF THE CITY OF FORT WORTH ( 1964) , AS AMENDED,
BY ADDING MOBILE HOME PARKS TO PLAN REVIEW FEES; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PROVISIONS
OF ORDINANCES AND OF SUCH CODE AFFECTING HEALTH AND SANI-
TATION; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABIL-
ITY CLAUSE; DIRECTING THE ENGROSSMENT AND ENROLLMENT OF
THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on August 6, 1985, the City Council adopted amendments
to the Permit Fee Schedule; and
WHEREAS, on August 6, 1985, the City Council expressed its in-
tention to amend Section 19-421.1, Plan Review Fee, by adding a plan
review fee for mobile home parks; and
WHEREAS, the amendments to the Permit Fee Schedule were incor-
porated into Ordinance No. 9455; and
WHEREAS, the amendment to Section 19-421.1 was not included in
any ordinance;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That Section 19-0421.1 of Chapter 19 of the Code of the City of
Fort Worth (1964), as amended, is hereby further amended by adding
(5) Mobile Home Park, and, after such amendment, shall read as fol-
lows:
"Sec. 19-421.1. Plan Review Fee.
"Plan Review Fees shall be charged as follows:
"(1) Food Service Establishments:
(a) 0 to 150 square feet
(b) 151 to 1,000 square feet
(c) 1,001 to 4,000 square feet
(d) 4,001 to 8,000 square feet
(e) 8,001 to 20,000 square feet
(f) 20,001 square feet and larger
(2) Public Swimming Pools, Public Spas
and Public Water Slides
(3 ) Mobile Food Unit ( excluding snowcone
vendors, ice cream truck vendors and
fruit and vegetable vendors)

SECTION 2.

This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1964), as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 3.
All rights and remedies of the City of Fort Worth, Texas, are
expressly saved as to any and all violations of the provisions of
Chapter 19 or any other ordinances affecting health and sanitation
which have accrued at the time of the effective date of this ordi-
nance; and, as to such accrued violations and all pending litiga-
tion, both civil and criminal, whether pending in court or not,
under such ordinances, same shall not be affected by this ordinance
but may be prosecuted until final disposition by the courts.
SECTION 4.
I t is hereby declared to be the intent ion of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 5.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and

Section 1 in the minutes of the City Council and by filing the
ordinance in the ordinance records of the City.
SECTION 6.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

n August 6, 1985, the City Council acted on certain proposed user fee adjust-
ents. At that time, the Council expressed its intention to amend Sec. 19-421.1,
lan Review Fee, by adding a plan review fee for Plobile Home Parks. However, the
ddition of a plan review fee for Mobile Home Parks was not included in the ordi-
ance. The attached proposed ordinance provides for this plan review fee.
