HomeMy WebLinkAboutContract 44176-A1 CITY SEC `s CONTRACT MO. , 1. 1' ►1 INTERLOCAL COOPERATION AGREEMENT Amendment 91 This Amendment #1 by and between the City of Fort Worth (City), the Regional Transportation Council(RTC),and the North Central Texas Council of Governments(NCTCOG), collectively referred to as the"Parties" is effective the day of-March WHEREAS, the City, RTC, and NCTCOG entered into an Interlocal Cooperative Agreement (Agreement) dated February 14, 2013, concerning the terms and conditions of repayment of certain regional toll revenue funds advanced for the BNSF Railway/FM 156 Relocation Project, which was necessitated by the Fort Worth Alliance Airport runway extension (City Secretary Contract No. 44176); and, WHEREAS, the City, RTC, and Denton County have been working in conjunction with GE Transportation to develop a funding strategy for the GE Test Track Project in north Fort Worth, including the use of a portion of the remaining funds under the original $80 million in Regional Toll Revenue Funds allocated to the BNSF/FM 156 Relocation Project; and, WHEREAS,on December 10,2015,the RTC approved the use of an additional$3 million from costs savings associated with the BNSF/FM 156 Relocation Project, for the GE Test Track Project, which brings the total amount of funds the RTC has approved for the GE Test Track Project to $15 million; and, WHEREAS, the Parties desire to reduce the amount of funds agreed to be repaid by the City under the Agreement by the amount of funds used to support the GE Test Track Project and desire to amend the Agreement accordingly; NOW THEREFORE, in consideration of these premises, the City, the RTC, and the NCTCOG agree to amend the Agreement as follows: rOFFICNAL 3ECORu VD C � v�YRUAF,RYpg � AQR 15 20116p Page 1 Section 4 of the Agreement is replaced in its entirety with the following: "The RTC and NCTCOG agree to waive repayment of the remaining$28,700,000.00 received by the City pursuant to the Advance Funding Agreement. The Parties acknowledge that the City has an obligation under the Advance Funding Agreement with TxDOT to return any unused funds plus interest to the Texas Department of Transportation. The Parties agreed that any unused funds returned to TxDOT or used to support the GE Test Track Project shall reduce the City's payment obligations under Section 2. Any interest returned shall not reduce the City's payment obligation under Section 2." EXECUTED on this the eday of 2016, in Fort Worth,Tarrant County, Texas. APPROVED: 04,�Q.
