ORDINANCE N0.
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING AN EMERGENCY ACCESS AND UTILITY EASEMENT AND
PRIVATE STREET KNOWN AS SHELL DRIVE, A 20-FOOT BY 20-FOOT
TRIANGULAR PUBLIC OPEN SPACE EASEMENT LOCATED ADJACENT TO
THE NORTHWEST CORNER OF SAID SHELL DRIVE, AND A 15-FOOT
WIDE SANITARY SEWER EASEMENT LOCATED WITHIN THE RIGHT-OF-
WAY OF SAID SHELL DRIVE, ALL OF WHICH ARE LOCATED IN
LOT 1, BLOCK 12, NEWELL AND NEWELL BUSINESS PARK, AS SHOWN
ON PLAT RECORDED IN VOLUME 388-57, PAGES 4 AND 5; DEED
RECORDS, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF
FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the emergency access and utility easement and private
street known as Shell Drive, the 20-foot by 20-foot triangular
public open space easement located adjacent to the northwest corner
of said Shell Drive, and a 15-foot wide sanitary sewer easement
located within the right-of-way of said Shell Drive, all of which
are located in Lot 1, Block 12, Newell and Newell Business Park, and
which are more particularly described in Exhibit "A", attached here-
to and incorporated herein, be and the same are vacated, abandoned
and permanently closed and extinguished as an emergency access and
utility easement, public open space easement and sanitary sewer
easement, respectively.
SECTION 2.
That the fee to the lands in the above described vacated emer-
gency access and utility easement, public open space easement and
sanitary sewer easement is hereby released and shall revert to the
adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

A PART OF LOT 1, BLOCK 12
NEWELL AND NEWELL BUSINESS PARK
FORT WORTH, TARRANT COUNTY, TEXAS
Being Shell Drive, a private street emergency access and utility easement,
a 15 ft. x 29 5 ft. sanitary sewer easement and a 20 ft. x 20 ft. Public
Open Space Easement, as shown by plat recorded in Volume 388-157, pages 4
and 5 of the Deed Records of Tarrant County and being more particularly
described as follows:
BEGINNING at the southeast corner of Lot 1, Block 12 as shown by said plat,
said point being in the center of the said Shell Drive;
Thence S 0` 04' E, 40.0 ft., to the southeast corner of the said Shell
Drive;
Thence N 88° 48' W, with the south of said Shell Drive 150.0 ft. to a point
in the east line of Handley-Ederville Road;
Thence N 0` 04' W,with the east line of Handley-Ederville Road at 40.0 ft.
the southwest corner of Lot 1, Block 12, at 80 0 ft.the north line of Shell
Drive and the south end of the said Public Open Space Easement in all
100.0 ft to the north end of the said open space easement;
Thence S 45` 04' E, 28.0 ft. to east end of the said Public Open Space
Easement and a point in the north line of the said Shell Drive;
Thence S 88` 48' E, 13.0 ft. to a point in the east line of the said Lot 1,
Block 12;
Thence S 0` 04' E, 40.0 ft to the place of beginning.

Background
Kenneth Newell, on behalf of Newell & Newell Limited Partnership, owners of all
abutting property, has requested that the City vacate an emergency access and
utility easement (private street) known as Shell Drive (80' wide x 150' long), an
adjacent 20' x 20' public open space easement (adjacent t~o the northwest corner
of Shell Drive) and a sanitary sewer easement (15' x 29.5') located within the
y~ight-of-way of Shell Drive, all on Lot 1, Block 12, Newell and Newell Business
Park, as recorded in Volume 388-157, Pages 4 & 5, peed Records, Tarrant County,
Texas, as shown on the attached map.
The subject private street, public open space easement and sanitary sewer ease-
ment, all acquired by dedication, contain no utility facilities. The subject
vacation request is made in order to utilize the vacated easements and private
street as part of the subject property, thus expanding the building area and pro-
viding more useable yard space.
The necessary and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the 'City.
Reviewing City departments and private utility companies have raised no objec-
tions to this request. A satisfactory replat has been submitted.
Recommendation
It is recommended that the City Council adopt an ordinance vacating an emergency
access and utility easement (private street) known as Shell Drive (80' wide x
150' long), an adjacent 20' x 20' triangular public open space easement and a
sanitary sewer easement (15' x 29.5') located within the right-of-way of Shell
Drive, all in Lot 1, Block 12, Newell and Newell Business Park.
