HomeMy WebLinkAboutOrdinance 9389~~~~ 1 W , «~ ORDINANCE N0. ~~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING CERTAIN UTILITY EASEMENTS LOCATED IN RIDGMAR MEADOW ADDITION, AS RECORDED IN VOLUME 388-173, PAGE 68, DEED RECORDS, TARRANT COUNTY, TEXAS; PROVIDING FOR REVER- SION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following utility easements, all of which are located in Ridgmar Meadow Addition to the City of Fort Worth, be and the same are hereby vacated, abandoned and permanently closed and extin- guished as public utility easements: A. The 10-foot wide utility easement located in Block 3R, said easement being more particularly described in Exhibit "A", said exhibit being attached hereto and incorporated herein; B. The 5-foot wide utility easement located in Block 3R, Lots 2 and 3, Block 4R-1, and across portions of Town Square Drive, said easement being more particularly described in Exhibit "B", said exhibit being attached hereto and incorporated herein; C. The 13-foot wide utility easement located in Block 3R, said easement being more particularly described in Exhibit "C", said exhibit being attached hereto and incorporated herein; D. The 10-foot wide utility easement located in Blocks 3R and 4R-1, said easement being more particularly described in Exhibit "D", said exhibit being attached hereto and incorpo- rated herein. SECTION 2. That the fee to the lands in the above described vacated public utility easements is hereby released and shall revert to the adja- cent owners as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. The subject utility easements, acquired by dedication, are platted but contains no utility facilities. The subject vacation request is made in order to utilize the vacated easements as part of the subject property thus expanding the building area and providing more useable yard space. The necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objec- tions to this request. A satisfactory replat has been submitted. Recommendation It is recommended that the City Council adopt an ordinance vacating four utility easements located in Blocks 3R and 4R-1 and a portion of Town Square Drive, all in Ridgmar Meadow Addition.
