HomeMy WebLinkAboutResolution 4617-04-2016 A Resolution NO. 4617-04-2016 APPOINTING A SUBSTITUTE HEARING OFFICER FOR THE AUTOMATED RED-LIGHT ENFORCEMENT PROGRAM WHEREAS, the City's Automated Red Light Camera Enforcement Program was adopted by City Council on July 31, 2007, (M&C G-15801) to improve safety at red light controlled intersections and is codified in Chapter 22, Article XII of the Code of the City of Fort Worth, Texas ("City Code"); WHEREAS, Section 22-366(c) of the City Code requires that City Council appoint one or more Hearing Officers with the authority to administer oaths, issue orders compelling the attendance of witnesses and production of documents, and conduct administrative adjudication hearings requested by individuals who wish to contest the imposition of a civil penalty; and WHEREAS, Jesus DeLuna is a new appointee to the position of Substitute Hearing Officer to serve a two year term; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1. THAT the person whose name appears below is hereby appointed as Substitute Hearing Officer with the authority to administer oaths, issue orders compelling the attendance of witnesses and production of documents, and conduct administrative adjudication hearings requested by individuals who wish to contest the imposition of a civil penalty for the terms specified below: Name Term Effective Date Term Expiration Date Jesus DeLuna April 19, 2016 April 18, 2018. 2. THAT the City Council has the right to remove any such Substitute Hearing Officer at any time and for any reason prior to the expiration of his term. 3. DISCUSSION: The City's Automated Red-light Camera Enforcement Program was adopted by the City Council on July 31, 2007, (M&C G-15801) to improve safety at red light controlled intersections and is codified in Chapter 22, Article XII of the Code of the City of Fort Worth, Texas (City Code). Section 22-366(c) of the City Code requires that City Council appoint one or more Hearing Officers with the authority to administer oaths, issue orders compelling the attendance of witnesses and production of documents and conduct administrative adjudication hearings requested by individuals who wish to contest the imposition of a civil penalty. On March 17, 2015, (M&C G-18437) the City Council approved Matt Bonner to serve as the Primary Hearing Officer. Jesus DeLuna shall serve for a term of two years, effective April 19, 2016 and will serve as the Substitute Hearing Officer when Mr. Bonner is unavailable. The City Council has the right to remove a Substitute Hearing Officer at any time and for any reason prior to the expiration of his term. This M&C does not request approval of a contract with a business entity.
