ORDINANCE NO. ~ ~7 ®~
AN ORDINANCE AMENDING ORDINANCE N0. 6205 OF
THE CITY OF FORT WORTH, TEXAS, WHICH ORDINANCE
PROHIBITS DISCRIMINATION AGAINST ANY PERSON
BECAUSE OF RACE, COLOR OR NATIONAL ORIGIN IN
PLACES OF PUBLIC ACCOMMODATION, BY EXTENDING
SUCH PROHIBITION-TO KINDERGARTENS, DAY CARE
CENTERS AND NURSERY SCHOOLS; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; RE-
PEALING ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING A SEVERABILITY CLAUSE AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF' THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 2 of Ordinance No. 6205 of the City
of Fort Worth, Texas, is hereby amended and after hav-

ing been so amended said. Section 2 shall hereafter read
as follows:
"As used in this ordinance, the term
°place of public accommodation° shall in-
clude every business within the City of Fort
Worth, whether wholesale or retail, which is
open to the general public and offers for
compensation any product, service or facility,
The term 'place of public accommodation' shall
include all hotels, motels, restaurants, bars,
lounges, night clubs or cabarets where food or
beverages are sold or offered for sale, theaters,
retail houses, washaterias, bowling alleys,
skating rinks, golf courses, all public con-
veyances, as well as the stations or terminals
thereof, kindergartens, day care centers and
nursexy schools."
SECTION 2,
That Section 3 (f) of Ordinance No. 6205 of the
City of Fort worth, Texas, is hereby amended. and after
having been so amended said Section 3 (f) shall hereafter
read as follows:

"(f) This ordinance shall not, however,
apply to any hotel, motel, restaurant, bar,
lounge, night club, cabaret or theater operated
by a bona fide private club when the accom-
modations, advantages, facilities and. services
are restricted to the members of such club and.
their guests; nor to any bona fide social,
fraternal, educational, civic, political or
religious organization, when the profits of
such accommodations, advantages, facilities
and. services, above reasonable and. necessary
expenses, are solely for the benefit of such
organization."
SECT ION 3
That this Ordinance shall repeal every prior ordinance
and provision of the Fort Worth City code in conflict here-
with but only insofar as the portion of such prior ordinance
or provision shall be in conflict, and. as to all other
ordinances or provisions of the Fort Worth City code not
in conflict herewith, this Ordinance shall be and is here-
by made cumulative,
SECTION 4~
If for any reason any section, paragraph, subdivision,
clause, phrase or provision of this ordinance shall be held.
invalid, it shall not affect any provisions of this or any
other ordinance of the City of Fort Worth to which these
rules and regulations relate, and. the provisions hereof are
declared to be severable.
SECTION 5,
This Ordinance shall be in full force and effect from
and after its passage and publication as required. by law,

The City Council at its meeting on June 21, 1971, requested the City staff
to prepare for the Council's consideration an amending ordinance to extend
the coverage of Ordinance No. 6205 (Public Accommodations Ordinance) to
include kindergartens, day care centers and nursery schools: The requested
amending ordinance has been prepared for Council consideration,
Specifically, the amending ordinance provides the following• Kindergartens,
day care centers and nursery schools have been listed under, Section 2_as
one of the. businesses subject to the conditions of Ordinance No. 6205;
and under Section 3, paragraph F, private kindergartens, day care centers
and nursery schools have been deleted from the listing of businesses exempt
from this ordinance,
Recommendation
It is recommended that City Council adopt the amending ordinance which has
been prepared making kindergartens, day care centers and nursery schools
subject to the conditions of Ordinance No. 6205.
