AN ORDINANCE PROVIDING FOR THE LEVY AND COLLECTION OF AN ANNUAL DIRECT AD VALOREM TAX ON ALL PRUPEMY, BBAL, PERSONAL AND JMIX3D, SITUATED WIT= THE TIM- RITORIAL LnMS OF THE OITY OF FORT WORTH, TEXAS, AND ALL PERSONAL PROPERTY OWNED IN SAID CITY OF FORT tiAmTL TTXAS, ON THE rnwT DAY OF JANUARY, A. D. 19 , MMUT SUCH PROFERTY AS MAY 1Z =EM FROM TAXATION BY THE CONSTITUTION AND LAMS OF TEM STATE OF TMUS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WOFCk'8. TEXAS: SECTION I. There is hereby levied and shall be collected, tae provided by law, an annual direct special ad valorem tax for the year 1931 for the support and maintenance of a free Public Library In the City of Fort Worth, Texas, of three cents (3$) on every One hundred Dollar (4100.00) valuation on all property, real, personal and mixed, situated in and all personal property owned in the City of Fort Worth, Texas, on the first day of January, A. D. 1939, liable under the law to taxation and not exempt therefrom by the Con- stitution and laws of the State of Texas. SECTION II. There is also hereby levied and there shall be collected, as provided by law, an annual direct special ad valorem tax for the year 1939, for the use and benefit of the Perk Fund of the City of Fort worth, Texas, of nine cents (9¢) on every one Hundred Dollar (#100.00) valuation on all property, real, personal and mixed, situated in and all personal property owned in the City of Fort Worth, Texas, on the first day of January. A. D. 1931, liable under the law to taxation and not exempt therefrom by the Constitution and laws of the State of Turas, which levy, in the aggregate sum of nine cents (9¢), as aforesaid, shall be and is hereby apportioned: Yor Park operation, maintenance, upkeep and to pay ma- turities and interest on park notes and warrants, 9 cents. The Commissioner of Accounts shall transfer from current tax Gollsotions the sum of $60983.93 to pay maturities and interest on notes and warrants. After this amount has been transferred to Park Interest and Sinking Fund, the remaining current tax collections will revert to the Park General Fund, as well as all delinquent taxes ool- leoted for prior years. SECTION III. Thera is also hereby levied and there shall be collected, as pro- vided by law, an annual direct special ad valorem tax for the year 1937, for the use and benefit of the Recreation Fund of the Oity of Fort worth, Texas, of two *onto (af) on every One Hundred Dollar ($100.00) valuation on all property, real, personal and mixed, situated in and all personal property owned in the 01ty of Fort Worth, Texas, on the first day of January, d. D. 1987, liable under the law to taxation and not exempt therefrom by the Con- stitution and laws of the state of Texas, which levy, in the aggregate sum of two vents (2¢)8 as aforesaid, shall be and is hereby apportioned: For Recreation operation, maintenance, upkeep and to pay maturities and interest on Recreation notes and warrants, E cents. The Commissioner of Accounts shall transfer from current tax collections the sum of *9,8168.50 to pay maturities, Interest and set up a Sinking Fund on notes and warrants. After this amount has been transferred to Recreation In- terest and Sinking Fund, the remaining current tax oolleo- tions will revert to the Recreation General Bund, as well as all delinquent taxes collected for prior years. SECTION I9. That there is also hereby levied and there shall be collected, as provided by law, an annual direct special ad valorem tax for the year 1937, for General Fund operations and for servicing of General Fund obligations outstanding of the said City of Fort Worth, of 1.81 dollars on every One Hundred Dollar ($100.00) valuation on all property, real, personal and mixed, situated in and all personal property owned in the City of Bort Worth, Texas, on the first day of Tanuary, L. D. 1939, liable under the law to taxation and not exempt therefrom by the Gonatitution and laws of the State of Texas. The Commisaioner of-Acoounts shall pay each week to the Interest and Sinking Bund forty-five per cent (45%) of the current taxes collected for General ]Fund operations and debt service until 1819,073.50 has been paid to the In- terest and Sinking Yund, after which all of said collections will remain in the general Bund. In this way the General Bund will absorb any Interest and Sinking Band delinquencies and In consideration of which will reaeive all delinquent tax sollections the entire year. That these special tax levies, which are hereinbefore mads, to pro- vide for the payment of interest and to create a sinking Hind or to discharge and pay principal and interest on any obligations due or owing by the City of Fort Worth, Tease, are not to be taken as in addition to levies for the same purpose in the respootive ordinances authorizing and creating such ob- ligations, bat the levies hereinbefore made are made pursuant to and for the purpose of carrying out and complying with the provisions of said prior ordi- nances, and ad valorem taxes herein are levied upon all taxable property, real, personal and mixed, situated in and all personal ptroperty owned in the City of Fort worth, Texas, as assessed, valued and described in tris assess- ment tax rolls and the tax books of the City of Fort worth, Texas, for the year 1937, and any supplowntal assessments thereof, as the some have boon or shall be presented to the City Council of the City of Fart Worth, Texas, by the.Assessor and Collector of Taxes of said City of Fort Worth, Texas. SECTION VI. That the taxes herein levied and authorized and required to be ool- looted shall be and become flue and payable in two oqual installments. The first installment, which amount shall be fifty per cent (50%) of the total sum of the taxes due and payable for the current year, shall be due and pay- able on the first day of October, A. D. 1937, and the second iuustallment, which amount shall be the reeaining fifty per cent (50A) of the total sum due and payable in taxes for the Current year, shall beoeme due and payable on the first day of April, A. D. 1938. SECTION VII. The first installment of taxes required to be paid by virtue of this ordinance for the current year shall become delinquent on the first day of December, A. D. 1937, and the second installment of taxes required to be paid by virtue of this ordinance for the current year shall became delinquent on the first day of 7tiuuo, A. D. 1938. SECTION VIII. Should any taxpayer permit his taxes to become delinquent, that is to say, should fail or refuse to pay the first installment, said installment being fifty per oent (50%) of the total amount of taxes due for the current year, before the first day of December, A. D. 1937, as above specified, then and in that event, the second installment shall also immediately become due and delinquent and a penalty shall attach to the payment of such taxes at Us rate of one per cent (lac) per month, or fraction thereof, for each month thereafter; and should any taxpayer pay the first installment of his taxes as hereinabove provided, but should permit the second installment of his taxes to become delinquent, that is to say, should fail or refuse to pay said second installment before the first day of Tune, A. D• 1938, as above specified, then the penalty shall attach to the payment of the second installment at the rate of one per cent (1%) per month, or fraotion thereof, on each month thereafter. SECTION I%. That said penalty of one per cent (1%) per month shall be added to said taxes in the event the payment thereof should become delinquent as above set forth and said penalty shall attach on the first day of each month there- after, until the taxes shall have been paid, which penalty shall be and become a part of said taxes and be payable as such; and provided further that in the event of the publication of the delinquent tax lists, or if suit is brought to recover such taxes and penalties and the delinquent taxpayer shall be subject to the payment of said taxes, penalties and costs, and the same shall be and become a lien upon the property of such taxpayer, as prescribed by the Charter of the City of Bort Worth, Texas, and the lame of the State of Texas, the said taxes with penalties and costs shall be and bsoome and they are hereby made a paramount lien to all other Ilona whatsoever on the property on which said taxes are levied. S=IOH X. Should any parts portion, section or part of a section of this ordi- nance be declared invalid or inoperative or Told for any reason by a court of competent ,jurisdiction, such decision, opinion or judgment shall in no way affect the remaining portions, parts, sections or parts of sections of this ordinance, which provision shall be, remain and continue to be in fall force and effect. 8=101 XI• That this ordinanoe shall take offset and be in full force and ef- fect frasl and after the date of its passggo as provided by law.
