ORDINANCE NO. ~~~ "°`.
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING A PORTION OF EVERMAN PARKWAY, A PUBLIC STREET
RIGHT-OF-WAY, SAID PORTION BEING OF VARIABLE WIDTH AND
EXTENDING FROM THE EAST RIGHT-OF-WAY LINE OF OAK GROVE
ROAD EASTERLY TO THE CENTERLINE OF A 40-FOOT WIDE DRAINAGE
CHANNEL EASEMENT LOCATED IN BLOCK 3, EVERMAN PARK SOUTH
ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
PROVIDING FOR RETENTION OF UTILITY EASEMENTS FOR EXISTING
AND PROSPECTIVE UTILITIES IN (SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH ,
TEXAS:
SECTION 1.
That a portion of Everman Parkway, a public street right-of-
way, said portion being of variable width and extending from the
east right-of-way line of Oak Grove Road easterly to the centerline
of a 40-foot wide drainage channel easement located in Block 3,
Everman Park South Addition, said portion of Everman Parkway being
more particularly described in Exhibit "A", attached hereto and
incorporated herein, be and the same is vacated., abandoned and per-
manently closed and extinguished as a public street right-of-way.
SECTION 2.
That the fee to the land in the above described vacated public
street right-of-way is hereby released and shall revert to the adja-
~ cent owner as provided by law, SAVE AND EXCEPT that easements are
retained for any and all existing and prospective utilities.
SECTION 3.
That all ordinances or parts of ,ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
da.ined.

Background
Bob R. franks, Trustee, .owner of all abutting property, hasrequested that the
City vacate a portion of Everman Parkway, a variable width from Aak Grove Road
east, southeast 641.29' to the centerline of a 4Q' drainage channel easement
within Block 3 of the Everman Park South Addition, as shown on the attached map.
The subject street right-of-way, acquired by dedication, consists of landscaped
parkway, which contains water, `sewer, and street light utility facilities,
The subject vacation request ~ made in order to replat the vacated right-of-way
with adjacent property, thus expanding the building area and providing more
useable yard spaca,

The necessary a,nd appropriate. monetary consideration has been placed in escrow
with the Real Property Department of L.he City.
Reviewing City departments and private utility companies have .raised no
objections to this request, subject to the filing of,.a satisfactory replat.. A
satisfactory replat has been submitted, w'
The City Plan Commission has reviewed this request and recommends that the
subject portion of street .right-of-way be vacated.

tg~is recommended that the City Council adopt an ordinance vacating a strip of
right-of-way variable in width from Oak Grave Road east, southeast :64129', to
the centerline of a 40' ,drainage channel easement .within,Block 3 of the Everman
