AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
EAST FIRST STREET AND ALL OF MAPLE STREET, SITUATED IN
THE B.F. CROWLEY SURVEY, ABSTRACT NO. 307, THE CITY OF
FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN THE
PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING
APPROXIMATELY, RESPECTIVELY, 45,058 AND 31,043 SQUARE FEET
ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF
FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of the variable width rights-of-way of East First Street situated in the B.F.
Crowley Survey, Abstract No. 307 of the City of Fort Worth, Tarrant County, Texas; as shown
on the plat of Booker Washington-121 Addition, an addition to the City of Fort Worth, Tarrant
County, Texas, recorded in the Plat Records of Tarrant County, Texas, and containing
approximately 1.0344 acres or 45,058 square feet of land more or less, and as more specifically
described in Exhibit "A" attached hereto and incorporated herein by reference be and the same is
vacated and extinguished.
SECTION 2.
That all of the variable width right-of-way of Maple Street, situated in the B.F. Crowley
Survey, Abstract No. 307, the City of Fort Worth, Tarrant County, Texas, as shown on the plat of
the Trinity Bend and S.J. Higgins Additions, addition to the City of Fort Worth, Texas, as
recorded in the Plat Records of"Tarrant County, "Texas, containing approximately 0.7126 acre or

31,043 square feet of land more or less, and as more specifically described in Exhibits "B"
attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 3.
That the easements to the land in the above-described vacated street rights of way are
hereby released and shall revert to the adjacent owner as provided by law.
SECTION 4.
All existing utility easements be shall be retained by the City until such time all utilities
located in the easements are relocated at the adjacent owner's expense.
SECTION 5.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 6.
That this ordinance shall take effect upon adoption.

Adopt Ordinance Vacating a Portion of East 1 st Street and Maple Street to be Replatted by TopGolf and
Chesapeake Land Development Company LLC, for a Golf Driving Range and Land Consolidation
(COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of East 1 st Street and Maple Street to be replatted by
TopGolf and Chesapeake Land Development Company LLC, for a golf driving range and land
consolidation; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Brockette Davis Drake, Inc., on behalf of TopGolf and Chesapeake Land Development Company, LLC,
has requested the vacation of these rights-of-way, to be replatted with the adjoining property for a new golf
driving range and land consolidation. The City Plan Commission recommended approval of this request
at its meeting on November 20, 2015. An acceptable final plat (FS-15-252) has been received in
accordance with the Subdivision Ordinance.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting
process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the rights-of-way easements. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of
purchase price of the right-of-way easements for the streets.
This project is located in COUNCIL DISTRICT 8, Mapsco 63T.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
