S, the City of Fort Worth (CITY) and Gary P. Kutilek d/b/a The
La a Alliance (ENGINEER) , made and entered into City Secretary Contract No.
44578 (the CONTRACT) , which was authorized by City Council (M&C C-27285) on the
5th day of May, 2015, in the amount of $ 322, 953 . 00; and
WHEREAS the CONTRACT involves engineering services for the following
project:
Northwest Community Park - Phase II; and
WHEREAS, it has now become necessary to execute administratively Amendment
No. 1 to the CONTRACT to increase the scope of work and revise the fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
CONTRACT:

Article I of the CONTRACT is amended to include the additional engineering
services specified in a proposal dated April 13, 2016, a copy of which is
attached hereto and incorporated herein. The cost to CITY for the additional
design services to be performed by ENGINEER totals $14,950.00. (See Attached
Funding Breakdown Sheet, Page -3- )
2.
Article II of the CONTRACT is amended to provide for an increase in the
fee to be paid to ENGINEER for all work and services performed under the
CONTRACT, as amended, so that the total fee paid by CITY for all work and
services shall be an amount of $337,903.00 .
3 .
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Amendment 1 - Design Proposal

Re: Northwest Community Park Phase II - Additional Services
Dear Bryan:
Pursuant to recent our recent conversations, I am forwarding a proposal for additional services related to
work elements not included in our original scope. These items include:
• Platting of the property
• Wastewater design for future concessions/restroom building
• Attendance at staff and Plan Commission meetings
• Subsurface investigations related to an existing petroleum products pipeline
Based on our Pre-Development meeting with City staff,we should pursue a minor plat with a waiver related
of extension of roadways into the park from the subdivision to the south, which would provide for a less
complicated platting process. Base fees referenced below include plat preparation by project surveyor,
presentation to Commission with exhibits and attendance of TLA and CP&Y to respond to any questions
or issues that may arise. If the Commission determines that access easements or other items are required
and/or a preliminary plat is required,additional fees will apply as referenced below. It is assumed that filing
fees for platting will be paid directly by the City.
You have determined that the schedule for a future concessions/restroom building,to be installed following
our project, make it prudent to install sewer service at this time. Our team will coordinate with the City
staff and design a service line to a location near the proposed building location.
Based on our current layout of Phase H and probable subsequent improvements within the park, we
recommend that subsurface utility engineering (SUE) Level `A' services be performed at a minimum of
three locations as shown on the attached drawing. The Level `A' SUE would provide horizontal and
vertical locations of the existing petroleum products pipeline(reported as a 6"non-high pressure line). The
service will include contacting the pipeline owner, coordination with their representative,potholing up to
a depth of 10 feet,and marking the locations and depth to the top of pipeline. This work will be conducted
by CP&Y, current civil consultant on the project . They will provide a written report on each pothole to
the surveyor along with instructions on what needs to be tied down. The surveyor,Spooner and Associates,
will then tie all pertinent information into the site survey coordinates. This information will allow us to

finalize the location of surface improvements and properly plan for other utilities that will need to cross this
area.
Proposed fees are as follows:
• Platting of Property(Minor Plat) with staff coordination and
representation to Planning Commission..................................................... $ 4,600.00
• Wastewater Design for future building ..................................................... $ 3,000.00
• Sue Services: $2,200 per hole for a total of................................................ $ 6,600.00
• Tie each exposed pothole into site survey................................................... $ 750.00
Total Proposed Base Cost(w/Minor Plat).............. $14,950.00
* It has been brought to our attention that access from the south may be an issue at the hearing and could
require additional services and costs in platting as referenced below:
*Alternate additional estimate if Preliminary/Final plat and/or access
easements are required................................................................................ $ 3,600.00*
Base cost assumes Minor Plat scenario as outlined during Pre-Development Conference. Additional costs
may apply if the staff or Planning Commission require additional platting and or easements. All fees,
deposits,or other direct application, filing or related governmental development costs will be paid directly
by the City. TLA will provide an estimate of fees at your request.
If this proposal meets with your approval, please initiate preparation of a contract agreement at your
