ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF DERTDDER AVENUE
AND PORTIONS OF SUNDRY OTHE~t STREETS, AVENUES AND PUELIC PLACES
IN THE CITY OP FORT WORTH, TEXAS9 DECLARYNG' TEE CONTRACT WITH
BOB MOORE, INC. FOR Ti-E CONSTRUCTION OF
SAID IMPROVEMENTS FULLY COMPI~TED AND PERFORMED a DIRECTING THE ~.
ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF
SPECIAL ASSESSMENT5 LEVIED AFTER GYVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAYNST SOME OF SAID ASSESSMENTS;
DIRECTING TY~ CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE
BY COPYING THE CAPTYON OF SAME IN THE MINUTE EOOI~ OF THE CITY
COUNCIL OF FORT WORTHfl TEXAS9 AND BY FILING THE COMPLETE ORDINANCE
YN APPROPRIATE ORDINANCE RECORDS OF SAYD CITY9 AND PROVIDING AN
EFFECTIVE DATE.
WH~REAS9 the City of Fort Worthy Texas9 has heretofore entered into a contract
with Bob Moore, Inc. , for the making and construction of
certain street improvements on the hereinafter described portions of streetsQ avenues and
public places in said Citya tom~rita
DERIDDER AVENUE From Hardy Street to Weber-~°Street, known and designated as
Project No. 021-036708-00, a seven-inch thick hot-mix asphaltic
concrete pavement 'with seven-inch high concrete curb and eighteen-
inch wide concrete gutter on a six-inch thick lime stabilized sub-
grade, so that the finished road way will be thirty-feet wide.
Six-inch thick concrete driveway approaches will be constructed
where required.
WHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 9274 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
vuHEtiI;AS, the City Council of the City of Fort ~~orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 9274 , and
WHEti1;AS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;

The improvements on each of t ho portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon, The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said propezty, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after diving
effect to such credit, if arty, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabave provided,
same shall be delivered to the Tax Assessox-Collector as part payment of the contract
prices
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worths Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,

This ordinance shall take effect and a in full force and effect from and after

Deviation from Bid Price
Final measured quantities at contract unit prices yield an earned total price
for this contract of $54,498.09 which is $2,049.31 (3.62%) under the bid price.
The underrun is the result of differen ces between quantities estimated for the
contract documents and quantities actually used to complete the work.
Financing
Sufficient funds are available for the recommended final payment to be made from
the Project No. 21-036708-00 account.
Compliance with Specifications
The project has been completed in accordance with the requ irements of the
contract.
Recommendation
It is recommended that the City Council accept the above project by the adoption
of an ordinance and final payment in the amount of $5,449.81 be made to Bob
Moore, Inc.
