AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING THE 26 FOOT WIDE EMERGENCY ACCESS AND UTILITY
EASEMENT LOCATED WITHIN- AND ADJACENT TO THE NORTH, EAST,
AND SOUTH PROPERTY LINES OF LOT 6-A, BLOCK 22, ALTA MERE
ADDITION, AS SHOWN ON PLAT RECORDED IN VOLUME 388-71, PAGE
276, PLAT RECORDS, TARRANT COUNTY, TEXAS; PROVIDING FOR
REVERSION OF FEE IN SAID LAND(S); RETAINING A 5 FOOT WIDE
UTILITY EASEMENT FOR EXISTING AND PROSPECTIVE UTILITIES;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVID-
ING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE 26 foot wide emergency access and utility easement
located within and adjacent to the north, east, and south property
lines of Lot 6-A, Block 22, Alta Mere Addition, as shown on plat
recorded in Volume 388-71 , Page 276, Plat Records, Tarrant County,
Texas, be and the same is vacated, abandoned, and permanently closed
and extinguished as a public emergency access and utility easement.
PROVIDED, however, that there is hereby retained a 5 foot wide
utility easement within and adjacent to the east property line of
the aforesaid lot.
SECTION 2.
That the fee to the land in the above described vacated emer-
gency access and utility easement is hereby released and shall
revert to the adjacent owner as provided by law, SAVE AND EXCEPT
that easements are retained for any and all existing and prospective
utilities in a 5 foot wide strip of land located within and adjacent
to the east property line of the aforesaid Lot 6-A, Block 22, Alta
Mere Addition.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed .
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-

Recommendation
It is recommended that the City Council adopt an ordinance vacating an existing
platted 26' wide emergency access and utility easement located entirely within
and adjacent to the north, east and south property lines of Lot 6-A, Block 22,
Alta Mere Addition, as recorded in Volume 388-71, Page 276, P.R.T.C.T., and as
shown on the attached map.
Discussion
G & S Company, a Joint Venture, by Peter Galier, co-venturer, owner of all abut-
ting property, has requested that the City vacate the above described emergency
access and utility easement. The subject easement, acquired by dedication, is
platted and contains telephone and electric utility facilities. The affected
utility companies have requested that a 5' utility easement be retained along the
east property line of the subject property to provide for the existing facili-
ties. A satisfactory replat has been submitted with the appropriate utility
easements delineated.
The subject vacation request is made in order to utilize the vacated easement as
part of the subject property, thus expanding the building area and providing more
usable yard space.
The required and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City.
Reviewing City departments and private utility companies have raised no objec-
tions to this request.
