ORDINANCE NO. _ ~~~_ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING CERTAIN PUBLIC STREETS AND PUBLIC ALLEY RIGHTS- OF-WAY, TO WIT: A PORTION OF EAST FIRST STREET; BRENTS STREET; SCOTT STREET; A PORTION OF HEATHCOTE STREET; BABY STREET, COOK STREET; QUILLEN STREET; SHADY STREET; THE NORTH/SOUTH ALLEY IN BLOCK 3, SHADY PARK ADDITION; THE EAST/WEST ALLEYS LOCATED IN BLOCKS 5, 6 AND 7, SHADY PARK ADDITION; RETAINING EASEMENTS FOR EXISTING AND PROSPECTIVE STORM DRAINAGE AND UTILITY FACILITIES; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; PROVIDING A SEVERABILITY CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. e BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following be and the same are vacated, abandoned and permanently closed and extinguished as public streets and alley rights-of-way: A. A portion of East First Street, from the west line of Lot 1, Mastin Industrial Park east to the east line of Lot 1, Block 1, Jerome Industrial Addition, said portion of East First Street being more particularly described in Exhibit "A", attached hereto and incorporated herein; and B. Brents Street, from East First Street south to East Fourth Street, said Brents Street being more particularly described in Exhibit "B", attached hereto and incorpora ed herein; and C. Scott Street, from East Fourth Street south to Heathcote Street, said Scott Street being more particularly described in Exhibit "C", attached hereto and incorporated herein; and D. .A portion of Heathcote Street, from the southwest corner of Lot 7, Block 3, Shady Park Addition east to the east line of Lot 7, Block 9, Shady Park Addition, said portion of Heathcote Street being more particularly described in Exhibit "D", attached hereto and incorporated herein; and E. Baby Street, from Clover Street east to the east line of Lot 29, Block 4, Shady Park Addition, said Baby Street being more particularly described in Exhibit "E", attached hereto and incorporated herein; and F. Cook Street, from East Fourth Street south and southeast to the east line of Lot 7, Block 9, Shady Park Addition, said Cook Street being more particularly described in Exhibit "F", attached hereto and incorporated herein; and G. Quillen Street, from Baby Street south to Heathcote Street, said Quillen Street being more particularly described in Exhibit "G", attached hereto and incorporated herein; and H. Shady Street, from Baby Street south to Cook Street, said Shady Street being more particularly described in Exhibit "H", attached hereto and incorporated herein; and I. The north/south alley located in Block 3, Shady Park Addition, from Baby Street to Heathcote Street, said alley being more particularly described in Exhibit "I", attached hereto and in- corporated herein; and J. The east/west alley located in Block 5, Shady Park Addition, from Cook Street to Quillen Street, said alley being more particularly described in Exhibit "J", attached hereto and in- corporated herein; and K. The east/west alley located in Block 6, Shady Park Addition, from Quillen Street to Shady Street, said alley being more particularly described in Exhibit "K", attached hereto and in- corporated herein; and L. The east/west alley located in Block 7, Shady Park Addition, from Shady Street to the east line of Lots 7 and 16, Shady Park Addition, said alley being more particularly described in Exhibit "L", attached hereto and incorporated herein. SECTION 2. That the aforesaid public easements in and to the lands in the above described vacated public streets and alley rights-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective storm drainage and utility facilities. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, illegal or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, illegality or uncon- stitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such void, illegal or uncon- stitutional phrase, clause, sentence, paragraph or section. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. f SECTION 5. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- ' dained. The subject vacation request is made in order to replat the vacated rights-of-way with adjacent property, to expand the building area, and provide more usable yard space. The required and monetary consideration has been delivered to the Real Property Department as required by the Land Agent for the City of Fort Worth. Reviewing City departments and private utility companies have raised no objec- tions to this request, subject to the vacated rights-of-way being replatted with adjacent property to include retention of required storm drainage and utility easements. A satisfactory replat has been submitted.
