AN ORDINANCE AMENDING SEC. 12-2 AND SEC. 12-3,
CHAPTER 12 OF THE CODE OF THE CITY OF FORT
WORTH (1964) BEING PROVISIONS CREATING TWO
OFFICES OF JUDGE OF THE CORPORATION COURTS; BY
PROVIDING THAT THE MAYOR WITH THE CONFIRMATION
OF THE CITY COUNCIL MAY ANNUALLY DESIGNATE ONE
OF THE TWO JUDGES AS CHIEF JUDGE; AND FURTHER
PROVIDING THAT UNLESS OTHERWISE DETERMINED BY
THE CITY COUNCIL THE CHIEF JUDGE MAY PRESCRIBE
CERTAIN CONDITIONS RELATIVE TO THE OPERATION
OF THE CORPORATION COURTS; REPEALING ALL OR-
DINANCES AND PROVISIONS OF THE FORT WORTH CITY
CODE IN CONFLICT HEREWITH; PROVIDING A SEVERABIL-
ITY CLAUSE; AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
SECTION 1,
That Sec, 12-2 of Chapter 12 of the Fort Worth City
Code is hereby amended, and, after being so amended, the
same shall read as follows:
"Sec. 12-2, Two judges' offices created; temporary
judges; chief judge,
"There are hereby created and recreated two
offices of judge or recorder, who shall meet
the qualifications specified in the Charter of
the city. The judges may transfer cases from
one court to another, and the judge of either
court may exchange his bench and preside over
the other court. The mayor shall have the power to
appoint, for a temporary period, such additional
or substitute judges of the corporation courts
as are deemed necessary. The mayor, with the
confirmation of the city council,, may annually
designate one of the two judges as chief judge.

SECTION 2,
That Sec, 12-3 of Chapter 12 of the Fort Worth City
Code is hereby amended, and, after being so amended, the
same shall read. as follows:
"Sec. 12-3. Powers of chief judge; authority
of judges,
"Unless otherwise determined by the City
Council the chief judge may prescribe the
conditions under which the additional or
substitute judges shall set as judge in
either of the corporation courts; further,
he shall direct the assignment and trial
of cases and order the transfer thereof
to or from either court. The judge of
either corporation court shall exercise
exclusive judicial authority over the
judgments, orders and. decrees of his parti-
cular court and the trial of cases therein.

SECTION 3.
This ordinance shall repeal every prior ordinance
and provision of the Fort Worth City Code in conflict
herewith but only insofar as the portion of such prior
ordinance or provision shall be in conflict, and as to
all other ordinances or provisions of the Fort Worth
City Code not in direct conflict herewith, this ordi-
nance shall be and is hereby made cumulative.
SECTION 4.
If any section, part of a section or provision of
any section of this ordinance shall be held to be void.,
ineffective or unconstitutional by a court of competent
jurisdiction, the holding of such section, part of a
section or provision of any section to be void, ineffective
or unconstitutional for any cause whatsoever shall in no
way affect the validity of the remaining sections and
provisions of this ordinance, which shall remain in full
force and effect. The City Council would not have passed
any sections, parts or sections or provisions of any
section of this ordinance that were unconstitutional,
void or ineffective if it had known that they were un-
constitutional, void or ineffective at the time of adopting
this ordinance.
SECTION 5.
This ordinance shall take effect and be in full
force and effect from and after the date of its passage
and it is so ordained.
