J.~ ORDINANCE NO. ~~-~~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A 20' WIDE ACCESS EASEMENT A'ND TWO ADJACENT PUBLIC OPEN SPACE EASEMENTS LYING ON, OVER AND WITHIN LOT 12-R, BLOCK 17, OF THE BERKELEY ADDITION OF THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT a 20' wide access easement and two adjacent public open space easements lying on, over and within Lot 12-R, Block 17, of the Berkeley Addition to the City of Fort Worth, according to the Plat recorded in Volume 388-176, Page 77 of the Plat Records, Tarrant County, Texas, and more particularly described in Exhibit "A"~at- tacked hereto and incorporated by reference herein in its entirety, be and the same are hereby vacated, abandoned, and permanently closed and extinguished as the easements described herein. SECTION 2. That the fee to the lands in the above described vacated ease- ments is hereby released and shall revert to the adjacent owners ras provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. S 89° 55' 00" E 1.21 feet to a point; 2. The subject 2U' access and two public open space easements, acquired by dedica- tion, are platted but contain no utility facilities. The subject vacation request is made in order to utilize the vacated easement as part of the subject property, thus expanding the building area and providing more usable yard space. It is the opinion of the Real Property Department that the rights and interest of the City in the subject 20' access and two public open space easements denoted in this request have no monetary value, if vacated. Reviewing City departments and private utility companies have raised no objec- tions to this request. A satisfactory replat has been submitted. Recommendation It is recommended that the City Council adopt an ordinance vacating the 2U' wide access easement and two adjacent public open space easements located within Lot 12-R, Block 17, Berkeley Addition.
