This Unified Sign Agreement will be governed by the laws of the State of Texas. 8. This Unified Sign Agreement may be amended or terminated only in accordance with Section 6.404 (F)(7)(b) of the Comprehensive Zoning Ordinance of the City of Fort Worth, Ordinance No. 13896, as amended,which reads as follows: { (b) A Unified Sign Agreement may be amended or terminated as follows: i) The amendment or termination agreement shall be executed by all owners of the properties included in the Unified Sign Agreement, and all lien holders, other than a taxing entity,that have an interest in land covered by the agreement or an improvement on such land. ii) A termination agreement shall be approved by the City Council if all Signs on the property governed by the agreement are in compliance with City sign regulations,as if no Unified Sign Agreement had been executed. Any signs that are not in compliance shall be removed or brought into compliance prior to approval of the agreement by the City Council: iii) m considering whether to approve an amendment to a Unified Sign Agreement, the City Council shall consider the criteria for approval of Unified Sign Agreements set out in Paragraph F.3. 9. Approved for Permits: 13/2%96 R4 Campus Unified Sign Agreement Written Description of Project- Reynolds Clearfork, LLC Introduction: R4 Campus in Clearfork is owned and operated by Reynolds Clearfork, LLC, and is comprised of three buildings on three contiguous lots inter-connected both spatially and professionally. This "wellness campus" is occupied by passionate professionals committed to providing wellness and hope in Fort Worth. R4 Campus rests at the entrance to Clearfork on the corner of Bryant Irvin Road and Edwards Ranch Road. The three architecturally consistent buildings were designed and constructed simultaneously to house R4 Gymnasium, R4 Foundation, and four pre- determined tenants working in the wellness industry. This unique campus is described in more detail on its website -R4Gym.com - on the About R4 Campus page. Lots are Eligible for Approval: The three lots comprising R4 Campus are all owned by Reynolds Clearfork, LLC. The lots are immediately adjacent to each other and interconnected by common areas, which include a courtyard, gardens, a small turf field, decorative stonework concealing campus-wide HVAC units, and a single parking lot with non-designated parking spaces. Further, each of the three buildings was constructed with the same materials and boasts the same visual design. Criteria for Sign Approval Met: Common name - The general public readily recognizes that the three lots of R4 Campus are contiguous and inter-related. R4 also holds itself out as one campus through its website, internet publications, and print media (as seen in the January 2016 cover-story of 360 West magazine). Shared parking—R4 Campus has one parking lot flowing behind the buildings on the north side of the campus. The lot is shared by all of the tenants and contains no tenant- specific parking spots. Unified Sign Agreement—Page 1 R4 Campus Shared signage—The Clearfork Association approved the proposed stone monument sign, which is 12 feet wide and 6 feet tall with the names of all seven tenants etched into the aluminum facade. The three numbered addresses are tastefully listed on one side and 'the "R4" Campus logo is prominently displayed on the upper-left of the sign. Physical layout—R4 Campus is comprised of three contiguous lots connected in a. cohesive manner both spatially and professionally. Joint premises—R4 Campus was designed and constructed to be a single development. R4 Campus is owned and operated by a single owner, Reynolds Clearfork, LLC, and utilizes a single salaried campus manager. Reduced clutter—The use of one campus sign on the only street corner possible for its display would benefit both R4 Campus and the city. The infeasible alternative is to place one Clearfork Association-approved monument sign in front of each building on Edwards Ranch Road. Following are the reasons that such a scenario would be impractical: 1) a very limited space exists between each building and the city's sidewalk; 2) a further trespass over a utility easement occupied by Atmos and AT&T would occur; 3) a potential hazard for drivers would exist as they strain to scan three signs in close proximity to one another; 4) unnecessary signage would clutter the busy roadway; and 5) the existing large entrance sign for the entire Clearfork area already rests where a sign for 5808 Edwards Ranch Road should reasonably rest. Zoning district—R4 Campus is in zoning district G. One Unified Sign Agreement—R4 Campus can only be subject to one unified sign agreement as it is comprised of three inter-connected buildings on three contiguous lots serviced by one parking lot, and owned by one entity, Reynolds Clearfork, LLC.
