HomeMy WebLinkAboutOrdinance 6036 R � W ORDINANCE NO. 4 3 AN ORDINANCE MAKING CERTAIN FINDINGS: PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 542 ACRES OF LAND, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PRO- VIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the 11th day of December, 1968, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the here- inafter described territory on the 26th day of November, 1968, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and, WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 197.630 square miles on January 1 , 1968, and WHEREAS, the hereinafter described territory lies within the extraterri- torial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory is annexed pursuant to a Joint Resolution adopted by the City of Fort Worth and by the City of Benbrook, which resolution, in strict accordance with the provisions of the Municipal Annexation Act, Article 970a, Revised Civil Statutes of Texas, apportions certain extra-territorial jurisdictional areas of the two cities and agrees on a common boundary; and WHEREAS, the territory hereinafter described contains approximately 542 acres; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . The following described land and territory lying adjacent to and adjoin- ing the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: TRACT 1 Commence at a point for corner in the present common boundary line of the City of Fort Worth and the City of Benbrook, said point of beginning being located in the west line of Bankhead Estates Subdivision out of the Heirs of Hays Covington Survey, abstract No. 256, said point also being in the north right of way line of Brook Chapin Road, said point also being the Southeast corner of Lot 15, Block 6, Waverly Place Addition, as said lot appears upon the map of record in the Plat Records of Tarrant County, Texas; THENCE in a westerly direction, along and with the north right of way of Brook Chapin Road, and a present City of Fort Worth city limit line, with its meanders, to a point for beginning of the tract herein described, said point being the intersection of the north right of way of Brook Chapin Road with the easterly right of way line of proposed Interstate Highway I-820, as said proposed right of way appears on a map on file with the Fort Worth office of the Texas Highway Department, which map was displayed at a public hearing held by the Texas Highway Department at the Benbrook Community Center on August 14, 1968; said point of beginning being further located as lying approximately 1700 feet easterly from Alameda Street; said point also being in a present City of Fort Worth city limit line. - 2 - THENCE in a southeasterly direction, along and with the easterly right of way line of proposed Interstate Highway I-820 to a point for corner at its inter- section with the southerly line of the Texas and Pacific Railroad Company right of way. THENCE in a southwesterly direction along and with the said railroad right of way line to a point for corner at its intersection with the centerline of Walnut Creek. THENCE in a generally southwesterly and westerly direction along and with the center line of Walnut Creek, with its meanders, to a point for corner, said point being defined and located for the purposes of this description as that point in the center line of Walnut Creek which is the shortest horizontal distance from the northwest corner of that certain channel easement to the State of Texas Highway Department (Parcel 17E, Part No. 3) as said easement appears of record in Volume 4219, page 194 of the Deed Records of Tarrant County, Texas, which said easement corner is also located in or near the south line of the N. Proctor Survey, Abstract No. 1229, said easement corner also being North 45 degrees - 48 minutes East 80 feet east from the easterly right of way line of State Highway No. RM 2871 . THENCE in a southwesterly direction to a point for corner, the northwest corner of the easement hereinabove described and continuing in a southwesterly direction to a point in the easterly right of way line of State Highway No. RM 2871 . THENCE southeasterly with the easterly right of way line of RM 2871 to a point for corner at its intersection with the north line of the Edward Taylor Survey, Abstract No. 1560. THENCE westerly 385 feet, more or less, with the north line of the Edward Taylor Survey, Abstract No. 1560 to a point for corner at the intersection of said survey line with the westerly right of way line of State Highway No. R. M. 2871 . THENCE northwesterly along and with the westerly right of way line of State Highway No. RM 2871 , a distance of 400 feet, more or less, to a point for corner. THENCE northeasterly, crossing State Highway No. 2871 and continuing north- easterly to a point for corner, which point stands 100 feet north from the above described point in the centerline of Walnut Creek which is the shortest hori- zontal distance from the northwest corner of the above described channel easement (Parcel 17E, Part No. 3). THENCE in a generally easterly and northeasterly direction along and with a line which is 100 feet generally northerly from, and parallel to, the center line of Walnut Creek to a point for corner in the westerly right of way line of proposed Interstate Highway I 820. THENCE northwesterly along and with the westerly right of way line of proposed Interstate Highway 1820 to a point for corner at the intersection of said right of way line with the north right of way line of Brook Chapin Road, said point of intersection being in the present city limit line of the City of Fort Worth. THENCE easterly, along and with the north right of way line of Brook Chapin Road and the present City of Fort Worth city limit line to the place of beginning and containing approximately 159 acres of land. - 3 - TRACT 2. Being the same area discontinued from the corporate area of the City of Benbrook by Tract 2 of its Ordinance No. 245, duly adopted on October 17, 1968, and being more particularly described as follows: BEGINNING at a point in the present city limit line of the City of Fort north, said point also being in a former city limit line of the City of Benbrook, said point of beginning being at the southeast corner of the J. Bartlett Survey, Abstract No. 187, said point being also an "L" corner of the J. J. Heath Survey, Abstract No. 641 . THENCE west with the south line of said J. Bartlett Survey, Abstract No. 187, and the south line of the J. S. Evans Survey, Abstract No. 485 to the northwest corner of the James Sharp Survey, Abstract No. 1386, and a northeast corner of the F. S. Merven Survey, Abstract No. 1910. THENCE south with the west line of the James Sharp Survey, Abstract No. 1386, to the southeast corner of the F. S. Merven Survey, Abstract No. 1910 and the north- east corner of the James 0. Quinn Survey, Abstract No. 1257. THENCE west with the James 0. Quinn Survey to the southwest corner of the F. S. Merven Survey, Abstract No. 1910, and the most northern southeast corner of the J. P. Smith Survey, Abstract No. 1885. THENCE north with the west line of the F. S. Merven Survey, Abstract No. 1910, to a point of intersection with a line projected westward on the centerline of Dirks Road, the same being County Road 1043 projected westward across Benbrook Lake to its intersection with the west line of the F. S. Merven Survey. THENCE easterly along said projection of the centerline of Dirks Road, at 2300 feet passing the west shoreline of Benbrook Lake at normal pool elevation 694 feet above sea level , in all 9400 feet to a point in the east water's edge of Benbrook Lake for a corner, the same being the point where the centerline of Dirks Road enters the water at elevation 694. THENCE South 20 feet to the place of beginning and containing 78 acres of land. TRACT 3. BEGINNING at a point for corner, the same being the southeast corner of the J. Bartlett Survey, Abstract No. 187, said point also being an "L" corner of the J. F. Heath Survey, Abstract No. 641 , said point also being in the present City of Fort Worth city limit line. THENCE west with the south line of the said J. Bartlett Survey, Abstract No. 187 to a point in the water's edge of Benbrook Lake when the lake is at normal pool elevation of 694, a distance of approximately 300 feet. THENCE northerly with the meanders of the shoreline of Benbrook Dake, at normal pool elevation of 694, to a point for intersection of said shoreline with the discharge pipe of Benbrook Lake Dam. THENCE in a northeasterly direction, crossing the Benbrook Lake Dam, along the centerline of said discharge pipe to a point in the centerline of the service spillway channel of Benbrook Lake Dam. - 4 - a THENCE in a northwesterly direction along the centerline of the service channel to a point for a corner at its intersection with the old natural channel of the Clear Fork of the Trinity River. THENCE in a northerly direction along and with the centerline of the Clear Fork of the Trinity River, with its meanders, to a point for corner at its inter- section with the south right of way line of proposed Interstate Highway I-820. THENCE easterly along the said southerly right of way line of proposed Interstate Highway I-820 to a point for corner at its intersection with a line projected across the east end of the proposed Trinity River bridges on I-820. THENCE north along a line projecting across the east end of the proposed Trinity River bridges to a point for corner at its intersection with the north right of way line of proposed Interstate Highway I-820. THENCE easterly with the north right of way line of proposed State Highway Inter- state I-820 to a point in the present City of Fort Worth city limit line, said point also being in the west line of the Mary E. Hook Tract (formerly known as C. 0. Edwards Tract), in the east line of the Educators Security Insurance Company Tract out of the James Rogers Survey, Abstract No. 1264. THENCE south to a point for corner in the west line of said Mary E. Hook tract which point stands 100 feet south from the south right of way line of proposed Interstate Highway I-820. THENCE west along a line parallel to and 100 feet south from the south right of way line of proposed Interstate Highway I-820 to a point for corner 100 feet east from the centerline of the Clear Fork of the Trinity River. THENCE in a generally southwesterly direction along and with a line 100 feet easterly and southerly from and parallel to the centerline of the Clear Fork of the Trinity River to a point for corner in the east line of the tracts acquired by the United States for Longhorn Park, said point for corner lying in the Joseph A. Dunham Survey, Abstract No. 409. THENCE southerly, southeasterly and southerly along the easterly lines of the tracts acquired by the United States for Longhorn Park to a point for corner in the north right of way line of County Road No. 1043. THENCE west along and with the north right of way line of County Road No. 1043 to a point for corner in a westerly line of the John F. Heath Survey, Abstract No. 641 , said point also being in the east line of the Jesse Bartlett Survey, Abstract No. 187. THENCE south along the lines of the said Heath and Bartlett Surveys to the place of beginning and containing approximately 305 acres of land. SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro - 5 - rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional , by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. On September 16, 1968, the City Council approved a joint resolution with the GRAHAM City of Benbrook providing for the adjustment of the common boundary and MAHONEY apportioning certain extraterritorial jurisdiction areas (M&C PZ-298) . ' F The joint resolution was approved by the City of Benbrook on October 3, 1968, and Ordinance No. 245 of the City of Benbrook was adopted on October 17, 1968, disannexing all of the property formerly within the City of Benbrook as required in the joint resolution. As a next step by the City of Fort Worth in implementing the realignment, the City of Fort Worth needs to create a new annexation strip or corridor around Benbrook following the proposed common boundary. After completion of the annexation procedures on the new strip, then Fort Worth can deannex those portions of the present strip as required by the joint resolution. Since a large part of the area made available for annexation by Fort Worth is presently undeveloped, it is considered premature to annex all of it at this time. The descriptions incorporated in the Notice of Public Hearing include certain lands which comprise a part of Longhorn Park (Benbrook Golf Course) on the east shore of Benbrook Lake. A copy of the timetable showing the sequence and timing of the necessary additional steps to accomplish the annexation and a map of the area are attached. Recommendation It is recommended that the City Council adopt a resolution setting December 9, 1968, at 9:30 a.m. as the time for public hearing on the con- templated annexation, and authorizing and directing the City Secretary to publish the notices required by State statute.
