HomeMy WebLinkAboutOrdinance 7136 ORDINANCE NO. V �J AN ORDINANCE ORDERING AN ELECTION OF THE QUALI- FIED VOTERS OF THE CITY OF FORT WORTH, TEXAS, ON TUESDAY, THE 8TH DAY OF APRIL, A. D. 1975, FOR THE PURPOSE OF ELECTING A MAYOR AND COUN- CILMEN FOR SAID CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That in compliance with the Charter of the City of Fort Worth and in accordance with the laws and Constitution of the State of Texas, an election be, and the same is here- by, called and ordered for the first Tuesday after the first Monday in April, A. D. 1975, the same being the 8th day of said month, at which election all qualified voters may vote for the purpose of electing a Mayor and Councilmen. SECTION II . That the City Secretary of said City shall prepare bal- lots to be used in voting machines in said election, on which ballots shall be printed the names of the candidates for the position of Mayor and Councilmen. The places of the different candidates shall be designated on the official ballot as Mayor, Place 1, and Member of Council, Places 2, 3, 4, 5, 6, 7, 8 and 9, respectively. SECTION III. That no person' s name shall be placed upon the official ballot as a candidate for the position of Mayor or as a mem- ber of the City Council unless such person has filed his sworn application, as provided by the laws of Texas, with the Mayor and the City Secretary at least thirty (30) days prior to the election date, and it must also appear on the face of said application the number of the place that said candidate is seeking. That no person' s name shall be placed upon the official ballot as a candidate for the position of Mayor or as a member of the City Council unless such person has filed a sworn statement, not less than seven (7) nor more than ten (10) days prior to Tuesday, April 8, 1975, of all gifts and loans previously received and of all gifts, loans and payments made, and of all debts and obligations incurred or contracted for future use in behalf of such person' s candidacy for office; that the statement must include all gifts, loans, payments, debts and obligations made or incurred, whether before or after the announced or filed candidacy of such person; and that not more than ten (10) days after the 8th day of April, 1975, each candidate shall also file a supplemental sworn statement of all gifts and loans received prior to the elec- tion and of all gifts, loans and payments made and debts and obligations incurred prior to the election which were not specifically included in the sworn statement filed prior to the election, all as provided for in Article 14.08 of the Election Code of the State of Texas. SECTION IV. That it shall further appear to the said City Secretary, before said candidate ' s name is entered on said ballot, that he has filed an affidavit of loyalty with the City Secretary, as required by Article 6.02 of the Election Code of the State of Texas. -2- SECTION V. That in the event that there are two or more candidates for the position of Mayor or for the same position and place as a member of the City Council, the order in which the names of such candidates are to be printed on the ballot shall be determined by a drawing to be conducted by the City Secre- tary; that three (3) days prior to the date on which the drawing is to be held, the City Secretary shall post a notice in his office in the City Hall of the time and place of the drawing and shall also give personal notice to any candidate who makes written request therefor and furnishes to the City Secretary a self-addressed stamped envelope; and that each candidate involved in the drawing or a representative desig- nated by him shall have a right to be present and observe the drawing. SECTION VI. That absentee voting shall be on paper ballots, and that each absentee voter shall vote for his choice for candidate for Mayor and for each place as a member of the City Council by placing an "x" in the square beside the name of each can- didate for whom he wishes to vote; provided, however, that if the voter places a plus sign (+) or a check mark (,/) , or any other mark which clearly shows his intention, in such place, it shall be counted as a vote for that candidate, pro- vided that no more names are thus marked than there are places to be filled. That the failure of a voter to mark his ballot in strict conformity with these directions or failure to vote a -full ballot shall not invalidate the ballot, and the ballot -3- shall be counted on all races wherein the intention of the voter is clearly ascertainable, except where the law ex- pressly prohibits the counting of the ballot. That it is specifically provided that the election officers shall not refuse to count an absentee ballot because of the voter' s having marked his ballot by scratching out the names of can- didates for whom he does not wish to vote; and that in this connection the attention of the Absentee Ballot Canvassing Board is directed to the provisions of Article 6.06 of the Election Code of the State of Texas. SECTION VII. That voting machines approved by the Commissioners ' Court of Tarrant County, Texas, shall be used at the City Council election on April 8, 1975, in strict compliance with the applicable provisions of Article 7.14 of the Election Code of the State of Texas, as amended, and other applicable pro- visions of such Election Code. SECTION VIII . That any candidate receiving a majority of all the votes cast for the office for which he is a candidate shall be elected to such office; but that in the event of a tie or in the event that no candidate receives a majority of all the votes cast for the office sought, the Mayor, on the first day after the completion of the official tabulation and canvass of the returns, shall issue a call for a second election, as required by law, to be held on the second Tuesday following the issuance of such call, at which second election the two -4- candidates receiving the highest number of votes for any such office or offices, as the case may be, in the first election at which no one was elected by receiving a majority of all the votes cast for all candidates for such office or offices shall again be voted for. SECTION IX. That the polls shall be kept open from seven o' clock A.M. , until seven o' clock P.M. , and that due return shall be made to the City Council showing the number of votes cast for and the number of votes cast against each candidate for the position of Mayor and for each of the positions of City Councilmen, respectively. SECTION X. That this ordinance shall constitute the proclamation calling and ordering said election; that such notice shall be published in a newspaper of general circulation in the City of Fort Worth once a week for four (4) weeks prior there- to; and that the said City Secretary is hereby directed to post or cause to be posted said proclamation in each voting precinct at least twenty (20) days before said election. SECTION XI. That the polling places for this election, the personnel of the officers who are to hold the same, and the Absentee Ballot Canvassing Board, except insofar as they may be changed by the City Council of said City, shall be as follows: -5- PRECINCT POLLING PLACE JUDGE 154 East St. Paul' s Baptist Church Barbara T. That said election shall be held under the provisions of the Charter of the City of Fort Worth, Texas, and the Con- stitution and laws of the State of Texas insofar as same may be applicable, and all duly qualified resident electors of -11- the City of Fort Worth, Texas, shall be allowed to vote in said election, and all electors shall vote in the precinct or polling place of their residence, or as provided by law. SECTION XIII. That the City Secretary is hereby ordered and directed to prepare and issue ballots for absentee voting and for voting machines and to stamp same "Official Ballot. " SECTION XIV. That the City Secretary of the City of Fort Worth shall furnish election officials said ballots and voting machines, together with any other forms, blanks or instruc- tions in accordance with the Charter of the City of Fort Worth, Texas, and the laws of the State of Texas insofar as same are applicable. SECTION XV. That the way and manner of holding this election, the notice to be given therefor, the polling places, the per- sonnel and the officers who are to hold same, and all de- tails connected with the holding of the election shall be provided for and arranged by the City Secretary; that the proper notice and publication of this notice, proclamation and ordinance shall only be cumulative of and in addition to the statutory notice of said election as herein provided; and that any omission or irregularity in the publication of this notice, proclamation and ordinance, or in the signing of same, shall not in any way affect or invalidate such elec- tion. -12- SECTION XVI. That this ordinance, election order, proclamation and notice shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained.
