HomeMy WebLinkAboutOrdinance 6490 ORDINANCE N0. 6 7 C, 0 AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 0.293 SQUARE MILES OF LAND, WHICH TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL CITIZENS OF FORT WORTH, TEXAS, PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PRO- VIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PRO- VIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas , wherein all interested persons were provided with an op- portunity to be heard on the proposed annexation of the territory hereinafter described, was held in the City Council Chamber in the City Hall of Fort Worth, Texas , on the 15th day of March, 1971 , which date is not more than (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS, notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas , and in the hereinafter described territory on the 4th day of March, 1971 , which date was not more than twenty (20) and not less than ten (10) days prior to the date of the opening of such public hearing; and WHEREAS, the population of the City of Fort Worth , Texas , is in excess of 393,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas , was 212.916 square miles on the lst day of January, 1971 ; and WHEREAS, the hereinafter described territory lies within the ex- clusive extraterritorial jurisdiction of the City of Fort Worth, Texas ; and WHEREAS, the hereinafter described territory contains approximately 0.293 square mile of land; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION I THAT the following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas , is hereby added to and annexed to the City of Fort Worth, Texas , and said territory hereinafter described shall be included within the boundary limits of the City of Fort Worth, Texas, and the boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas , to wit: BEING a tract of land about nine miles northwest of the courthouse of Tarrant County, Texas, lying in the J. Wilcox Survey No. 33, consisting of that certain territory discontinued from the City of Fort Worth by Ordinance No. 4971 , and "BEGINNING at a point in the east right-of-way line of Rankin Road at its intersection with the City Limit Line of the City of Fort Worth as referred to in the corporate boundary description of the City of Fort Worth, as contained in the Fort Worth City Code of 1950; "THENCE northeasterly along the east right-of-way line of Rankin Road and of Rankin Road produced north to the northeasterly right-of-way line of Jacksboro Highway (U.S. Highway No. 199); "THENCE northwesterly along the northeasterly right-of-way line of Jacksboro Highway to its intersection with the City Limit Line of the City of Fort Worth as referred to in the corporate boundary description of the City of Fort Worth, as contained in the Fort Worth City Code of 1950; "THENCE easterly, southerly, and westerly along the City Limit Line of the City of Fort Worth, with its meanders, as referred to in the corporate boundary description of the City of Fort Worth, as contained in the Fort Worth City Code of 1950, to the place of beginning and containing approximately .293 square miles." SECTION II THAT the above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION III THAT this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in conflict herewith this ordinance shall be and is hereby made cumulative. SECTION IV THAT it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of a court of competent jurisdiction, such un- constitutionality shall not affect any of the remaining phrases, clauses , sentences, paragraphs and sections hereof, since the same would have been enacted by the City Council without the incorporation herein of any such void, - 2 - ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION V THAT this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained. The City's POLICY FOR REVIEW OF ANNEXATION AND DEANNEXATION'REQUESTS, states th t "land will be considered for- annexation when its proximity to the City, the rate of� growth of the "City, and other factors indicate that annexation of the area would aid the City's growth and development, or when annexation is required to guard against uncontrolled development not consistent with long-range land use needs of -the area." The areas proposed for annexation in this report are bounded on at least tiro sides by the City of Fort Worth; some are virtually surrounded by Fort Worth. These areas are subject to development at any time, with the exception of the City-operated Southeast Landfill site (Q-69-7) . Because of the proximity of all the areas proposed to be annexed to the City of Fort Worth, it would be desirable for the City to have that control which only annexation can provide for the following reasons: (1) . To prevent undesirable development or deterioration (2) To guide development as per present and/or pending plans , viz. The Preliminarg Plan for the 1980 Urban Area L sector plans , district plans (3) To aid police and fire calls „by better establishing jurisdic- tional lines (4) To eradicate enclaves of unannexed land presently pocketed by the municipal boundaries of Fort Worth (5) To bring municipally owned and/or operated territory within the city limits. A "Report on Proposed Annexations” is attached which outlines in greater detail considerations concerning this annexation proposal and includes reprints of co ission and departmental reports, and detailed maps of .the areas proposed for vexation. MATE rix"ERENCE SUBJECT: Recommended Annexation - PACE NUMBER Seven "Lnclave" Areas 2 2 3/1/71 PZ-427 °} -- Q-69-20: A 0.132 square mile rectangular tract located northeast of the Greater Southwest International Airport site and generally bounded on the north by Highway 183, on the east by the Tarrant-Dallas County Line, and on the west and south by airport property. Q-69-21: A 0.296 square mile enclave located east of the Village of Lakeside and surrounded on three sides by park property. Q-69-22: A 0.08 square mile triangular enclave located south of Saginaw and generally bounded on the west by U.S. Highway No. 81 on the east by the C.R.I. & G. Railroad. Q-69-25: A 0.9 square mile tract generally bounded on the north by U.S. High- way 80, on the west by Marys Creek North, on the south by Marys Creek and on the east by proposed I-820. Q-69-26: A 0.184 square mile tract located west of Westwood Addition, east of the new Hulen Street extension and north of the Santa Fe indus- trial tract. City Plan Commission Recommendation In May, 1969, and January , 1971, these areas were recommended for annexation by the City Plan Commission. Municipal Services The City of Fort Worth can provide all municipal services , including police and fire protection, to all of the areas proposed for annexation. - However, in areas Q-69-20 (the GSIA enclave) and Q-69-21 (the enclave east of Lake- side Village) it would be difficult to provide water and sewer facilities. Recommendation It is recommended that the City Council authorize the City staff .to initiate annexation proceedings on the areas reported herein.
