ORDINANCE NO. ~® l
AN ORDINANCE AUTHORIZING THE PAYMENT OF AN ADDITIONAL
AMOUNT NOT TO EXCEED $10,000 TO THE FIRM OF VINSON &
ELKINS FOR WORK TO BE PERFORMED REGARDING THE AMENDMENT OF
WATER PERMIT NO. 2413 BEFORE THE TEXAS WATER COMMISSION;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL PRIOR ORDI-
NANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the City Manager of the City of Fort Worth is hereby
authorized to pay to the firm of Vinson & Elkins an additional sum
not to exceed $10,000 which will increase to $60,000 the maximum
amount to be paid for services to be rendered on behalf of the City
of Fort Worth in the amendment of Water Permit No. 2413 now pending
before the Texas Water Commission.
SECTION 2.
Should any portion, section or part of a section of this Ordi-
nance be declared invalid, inoperative or void for any reason by a
court of competent jurisdiction, such decision, opinion or judgment
shall in no way impair the remaining portions, sections or parts of
sections of this Ordinance, which said remaining provisions shall be
and remain in full force and effect.
SECTION 3.
That this Ordinance shall be cumulative of all other ordinances
and appropriations for which provision has been heretofore made and
they are hereby expressly repealed if in conflict with the provi-
sions of this ordinance.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption in the
minutes of the City Council and by filing the ordinance in the ordi-
Hance records of the City.

SECTION 5.
That this Ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

The City Council approved M&C C-6510 on 9-21-82, authorizing the employment of
Vinson & Elkins as outside counsel to assist the City Attorney with water
matters that were pending before the Texas Water Commission. Under the terms
of City Ordinance No. 8646, a maximum sum of $50,000 was allocated for the
purpose of paying Vinson & Elkins for services rendered on behalf of the City
of Fort Worth in the amendment of Water Permit No. 2413, presented before the
Texas Water Commission. The prolonged discussions with the Tarrant County
Water Control & Improvement District No. 1, the City of Weatherford and the
Benbrook Water and Sewer Authority concerning a water rights application for
the remaining uncommitted storage in Lake Benbrook have resulted in a
continuance of the hearing before the Texas Water Commission. The staff of the
Water District has assured the Advisory Committee that a draft agreement will
be available by the first day of May. Continued legal services will be needed
until a settlement is negotiated.
To date, payment of $49,388.51 has been made to Vinson & Elkins. An additional
$10,000 is needed to cover the additional expenses, which, is anticipated will
accrue, before these issues are resolved. Currently a balance of $611.49
remains in the Fund 45 Account No. 60-90-10 and the department has received an
invoice for $907.70 from Vinson & Elkins.
A budget adjustment will be prepared and submitted to transfer $10,000.00 to
Account No. 60-90-10, from Account Fund 45, Account No. 60-20-00, Index Code
370601.
Recommendation
It is recommended that the City Council approve the attached ordinance
increasing by $10,000.00 the amount which may be paid to the firm of Vinson and
Elkins, which will increase the maximum amount payable to $60,000.00.
