HomeMy WebLinkAboutOrdinance 18008-03-2008Ordinance No. 18008-03-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $502,452.00, FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING A CONTRACT WITH MCCLENDON CONSTRUCTION COMPANY, INC. FOR PAVEMENT RECONSTRUCTION AND SANITARY SEWER REPLACMENT ON SAUNDERS ROAD (CITY PROJECT NO. 00056); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $502,452.00 from available funds, for the purpose of executing a contract with McClendon Construction Company, Inc., for pavement reconstruction and sanitary sewer replacement on Saunders Road (City Project No. 00056). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $502,452.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund in the amount of $502,452.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $502,452.00, from available funds; and 3. Authorize the City Manager to execute a contract with McClendon Construction Company, Inc., in the amount of $1,741,428.45 for pavement reconstruction and sanitary sewer main replacement on Saunders Road (Marie Jones to E. Loop 820 S). DISCUSSION: On May 30, 2000, (M&C C-18034) the City Council authorized the City Manager to execute an engineering agreement with Wier Associates, Inc., for Pavement Reconstruction Design and Sanitary Sewer Main Replacement on Saunders Road (DOE 2214). The 1998 Capital Improvement Program (CIP) and the 2004 COP included funds for pavement reconstruction on Saunders Road. Street improvements include concrete pavement reconstruction; construction of standard concrete curb; and driveway approaches and storm drain improvements as indicated on the plans. During design on Saunders Road, the Consultant recommended constructing a major storm drainage system in order to eliminate flooding on this project. The project was delayed until the storm drainage improvements were designed and the necessary easements obtained. The 1998 Bond, did not include adequate funds for the drainage improvements and for the necessary easements. Subsequently, funding for the storm drainage improvements and easements was provided through the 2004 Capital Improvement Program. The Water Department has determined that severely deteriorated sanitary sewer lines should be replaced prior to street reconstruction. Funding in the amount of $16,714.00 is included for associated sewer construction survey, project management, pre-construction, material testing, inspection and project close out. The contingency funds to cover change order for sanitary sewer main replacement is $23,130.00. Funding in the amount of $57,970.00 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. The contingency fund for possible change orders for paving and drainage improvement is $38,365.00. M/WBE -McClendon Construction Co., Inc., is in compliance with the City's M/WBE Ordinance by committing to 21 percent M/WBE participation on this combined project. The City's goal on this project is 20 percent. This project is located in COUNCIL DISTRICT 5, Mapsco 93P. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval and completion of recommendations,adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Sewer Capital Projects Fund, Street Improvements Fund and Critical Capital Projects Fund.
