ORDINANCE NO. ~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A PORTION OF PINE TREE CIRCLE SOUTH, A 40 FOOT WIDE EMERGENCY ACCESS AND UTILITY EASEMENT, FROM THE WEST PROPERTY LINE OF LOT 30, BLOCK 1, PINE TREE MOBIL HOME ESTATES NO. 2 ADDITION, EASTWARD 100 FEET TO GOLDEN TRI- ANGLE CIRCLE; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT a portion of Pine Tree Circle South, a 40 foot wide emer- gency access and utility easement, from the west property line of Lot 30, Block 1, Pine Tree Mobile Home Estates No. 2 Addition, east- ward 100 feet to Golden Triangle Circle, be and the same is vacated, abandoned, and permanently closed and extinguished as an emergency access and utility easement. SECTION 2. That the fee to the land in the above described vacated emer- gency access and utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Estates X62, Block 1, Lot 30, Block 8, 1 °' Lot 1 (V-84-30) Pine Tree Development Corporation, owner of all abutting property, has requested that the City vacate a portion of Pine Tree Circle South, a 40' wide emergency access and utility easement, from the west property line of Lot 30, Block 1, Pine Tree Mobile Home Estates No 2 Addition, eastward 100' to Golden Triangle Circle, as shown on the attached map The subject emergency access and utility easement right-of-way, acquired by dedication, is partially open on the ground and contains no utility facilities The subject vacation request is made in order to replat the vacated right-of-way with adjacent property, thus expanding the building area and providing more usabl yard space The necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City Reviewing City departments and private utility companies have raised no objections to this request provided the vacated right-~f-way is replatted with adjacent property A satisfactory replat has been submitted. The City Plan Commission has reviewed this request and recommends that the subject emergency access and utility easement be vacated as regeusted. Recommendation It is recommended that the City Council adopt an ordinance vacating a portion of the Pine Tree Circle South, as recommended by the City Plan Commission DAI kc Attachment APPROVED BY ?
