HomeMy WebLinkAboutResolution 4622-05-2016 A Resolution NO. 4622-05-2016 AUTHORIZING RETENTION OF THE LAW FIRM OF JACKSON WALKER AS OUTSIDE LEGAL COUNSEL TO ADVISE THE CITY ON TAX AND LABOR AND EMPLOYMENT LAW ISSUES AND SETTING MAXIMUM COMPENSATION WHEREAS, there are legal issues concerning employment tax and labor and employment law issues which staff needs direction from an attorney with expertise in these areas; and WHEREAS, Jackson Walker has special competency and recognized expertise in the area of employment tax and labor and employment law and has agreed to assist the City with these issues. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: I. That the engagement of the Law Firm of Jackson Walker as outside legal counsel be confirmed pursuant to Chapter V1, Section 3, of the City Charter, in order to provide legal representation to the City concerning interpretation and application of federal tax law. 1I. DISCUSSION: There are legal issues concerning employment tax and labor and employment law which Staff needs direction from an attorney with expertise in these areas. Chapter VI, Section 3 of the City Charter requires the City Council to approve the retention of any outside legal counsel for assistance to the City Attorney. Because of the nature of the issues involving employment tax law and labor and employment law, it is recommended that City Council adopt the attached resolution authorizing the retention of the law firm of Jackson Walker, L.L.P., to advise the City on these issues. It is also recommended that the City Council authorize payment of up to $15,000.00 in counsel fees. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that, upon approval of the above recommendations, funds will be available in the current operating budget of the General Fund. The funds will be transferred from non- departmental to City Attorney's Office through the use of delegated authority for the aforementioned purpose.
