ORDINANCE NO. ~~~_
AN ORDINANCE APPROPRIATING THE ADDITIONAL SUM OF $25,000
FROM THE WATER AND SEWER FUND UNAPPROPRIATED FUND BALANCE
TO ACCOUNT NO. 70-90-00 TO PROVIDE FUNDS FOR COMPENSATION
TO THE FIRM OF VINSON AND ELKINS; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That there is hereby appropriated from the Water and Sewer Fund
Unappropriated Fund Balance to Account No. 70-90-00, the additional
sum of $25,000 for payment of the firm of Vinson and Elkins for its
legal services relating to the expansion of the City of Fort Worth
Sanitary Sewage system and the development of growth management
policies for the system.
SECTION 2.
That, should any portion, section or part of a section of this
Ordinance be declared invalid, inoperative or void for any reason by
a court of competent jurisdiction, such decision, opinion or judg-
ment shall in no way impair the remaining portions, sections or
parts of sections of this Ordinance, which said remaining provisions
shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of all other ordinances
and appropriations except in those instances where the provisions of
this ordinance are in direct conflict with such other ordinances and
appropriations, in which instances said conflicting provisions are
hereby expressly repealed.
SECTION 4.
That the City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the caption
in the minutes and by filing the ordinance in the ordinance records
of the City.

SECTION 5.
That this Ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

On December 3, 1981 (M&C 6029), the City Council authorized the employment of
the law firm of Vinson and Elkins to assist the City Attorney with matters
relating to the operation and future expansion of the City's sanitary sewage
system. The sum of $50,000 was appropriated for this purpose from the unappro-
priatedretained earnings of the Water and Sewer Fund.
On May 10, 1983 (M&C G-5616), the City Council authorized an additional $25,000
for the continued employment of Vinson and Elkins as special counsel to provide
legal assistance with respect to the operation and expansion of the City's san-
itary sewage system.
To date, Vinson and Elkins has been paid a total of $72,713.73 for its legal
assistance on sewage matters. A balance of $2,286.27 remains in the legal ser-
vices contract with Vinson and Elkins. It is proposed to utilize the services
of Vinson and Elkins for special legal assistance in the development of growth
management policies. This assistance would include listing and summarizing
state statutes and regulations related to the powers of cities both inside and
outside corporate limits and pertinent briefings of clarifying legal cases. It
is estimated that these services will cost $25,000.
Recommendation:
It is recommended that the City Council:
(1) Adopt the attached Resolution increasing to $100,000 the total amount
allowed to be paid to Vinson and Elkins for its services relating to
expansion of the City's water and sewer system and the development of
growth management policies for the system, and
(2) Approve the attached supplemental appropriations ordinance, appropriating
$25,000 from the unappropriated retained earnings of the Water and Sewer
Fund, to Account No. 70-90-00, Index Code 3,90799 to provide additional
funds to pay for the services of Vinson and Elkins.
