HomeMy WebLinkAboutOrdinance 9211 < < ,~~ ,~.: , .~ ~=: -y ORDINANCE NO. oC.~/ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A PORTION OF THE 5-FOOT WIDE EAST/WEST UTILITY EASEMENT LOCATED IN LOT 1, BLOCK 1, SHADY OAKS TOWNHOUSES ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT a portion of the 5-foot wide east/west utility easement located in Lot 1, Block 1, Shady Oaks Townhouses Addition, said por- tion being more particularly described by metes and bounds in Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished as a public utility easement. SECTION 2. That the fee to the land in the above described vacated public utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Bass, owner of all abutting property, has requested that the City vacate a 5' x 22' portion of the 5' wide east/west utility easement in Lot 1, Block 1, Shady Oaks Townhouses Addition, from a point 45' west of Roaring Springs Road westerly 22' to a point 65' west of said Roaring Springs Road, as shown on the attached map. The subject utility easement, acquired by dedication, is platted but con- to-ins no utility facilities. The subject vacation request is made in order to incorporate the vacated right-of-way with adjacent property, to expand the building area, and provide more usable yard space. It is the opinion of the Real Property Department that the interest of the City in the subject utility easement described in the vacation request has no monetary value to the City if it is vacated. Reviewing City departments and private utility companies have raised no objections to this request. RECOMMENDATION: It is recommended that the City Council adopt an Ordinance vacating the 5' x 22' portion of the 5' wide east/west utility easement in Lot 1, Block 1, Shady Oaks Townhouse Addition.
