AN ORDINANCE VACATING AND EXTINGUISHING A
PORTION OF MERCANTILE DRIVE RIGHT OF WAY,
LOCATED IN LOT 3 AND 4 BLOCK 3 OF THE MERCANTILE
CENTER ADDITION, AN ADDITION TO THE CITY OF FORT,
AS RECORDED IN VOLUME 11752, PAGE 190 AND VOLUME
11752, PAGE 207 OF THE DEED RECORDS OF TARRANT
COUNTY TEXAS, CONTAINING APPROXIMATELY 1,423
SQUARE FEET OF LAND; PROVIDING FOR REVERSION OF
FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL
RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That a portion of Mercantile Drive right of way, located in Lots 3 and 4, Block 3
of the Mercantile Center Addition, David Odom Survey, Abstract No. 1184, as recorded
in Volume 11752, Page 190 and Volume 11752, Page 207 of the Deed Records of
Tarrant County Texas, containing approximately 1,423 square feet or 0.033 acre of land,
and as more specifically described in Exhibits "A" and "B" attached hereto and
incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is
hereby released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility easement be shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

DESCRIPTION, of a 1,423 square foot (0 033 acre) #ract of land situated in the David Odum Survey,
Abstract No 1184, Tarrant County, Texas; said tract being part of that tract of land described in Special
Warranty Deed to Mercantile Partners, ~ P recorded in Volume 11752, Page 190 and Volume 11752,
Page 207 of said Deed Records; said 1,423 square foot tract being more particularly described as
follows:
BEGINNING, at a point for corner in the existing west right-af-way line of Mercantile Drive (a 68-foot wide
right-of-way); said point being the beginning of a curve to the left;
THENCE, along the said existing west line of Mercantile Drive, the following three (3} calls:
In a westerly direction, along said curve to the left, having a central angle of 86 degrees, 30 minutes, 38
seconds, a radius of 20 00 feet, a chord bearing and distance of North 73 degrees, 28 minutes, 52
seconds West, 27 41 feet, an arc distance of 30 20 feet to a point at the end of said curve;
North 26 degrees, 38 minutes, 22 seconds West, a distance of 68 00 feet to a point for corner; said point
being the beginning of anon-tangent curve to the left;
In a northerly direction, along said curve to the left, having a central angle of 88 degrees, 24 minutes, 25
seconds, a radius of 19 70 feet, a chord bearing and distance of North 19 degrees, 53 minutes, 21
seconds East, 27 47 feet, an arc distance of 30 40 feet to a point at the end of said curve; said point
being the beginning of a rion-tangent curve to the left;
THENCE, in a southerly direction, along the proposed west line of Mercantile Drive and along said curve
to the left, having a central angle of 06 degrees, 20 minutes, 54 seconds, a radius of 954 00 feet, a chord
bearing and distance of South 26 degrees, 40 minutes, 05 seconds East, 105 65 feet, an arc distance of
105 70 feet to the POINT OF BEGINNING;

Adopt an Ordinance Vacating a Portion of Mercantile Drive Right of Way, Containing Approximately
1,423 Square Feet, Located in Lots 3 and 4, Block 3, Mercantile Center Addition, in the City of Fort
Worth, Tarrant County, Texas, and Waive Purchase Fees
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating a portion of Mercantile Drive right of way, containing approximately 1,423
square feet, located in Lots 3 and 4, Block 3, Mercantile Center Addition, as recorded in Volume 11752,
Page 190 and Volume 11752, Page 207, Deed Records, Tarrant County, Texas; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624).
DISCUSSION:
Pacheco Koch Consulting Engineers, on behalf of Mercantile Partners, L.P., has requested to vacate the
above referenced right-of-way and to replat and incorporate it within the adjoining property since the
planned street is no longer required. This stubout of Mercantile Drive was originally planned to continue;
however, it has been deemed unnecessary. The City Plan Commission recommended approval of this
request at its meeting on October 24, 2007. An acceptable replat (FS-07-256) has been received. Any
existing utilities will be relocated at the applicant's expense, or retained within a designated easement,
along with an appropriate plat note that no permanent structures may be constructed or placed thereon.
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process.
The City does not own land under, or adjacent to, the above referenced right-of-way. Since no City funds
have been expended to purchase property or easement rights, collection of the fee value or any portion
thereof is recommended by staff to be waived.
This request is located in COUNCIL DISTRICT 4
