IN THE CITY OP PORT WORTHa TEXAS9 DECLARING THE CONTRACT WITH
Bill Shannon, Inc. FOR THE CONSTRUCTION OF
SAID IMPROVEA4ENTS FULLY COY~IPLETED AND PERFORI~tED g DIRECTING THE
ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OP
SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAINST SOI+lE OP SAID ASSESSl~NTS;
DIRECTING THE CYTY SECRETARY TO ENGROSS AND ENROLL THIS ORDDINANCE
BY COPYING THE CAPTYON OF SAASE IN THE 1rlINtJT~ BOOR OF THE CITY
COUNCIL OF FORT WORTHS TEXAS, AND BY PILING THE COI~4PLETE ORDINANCE
YN APPROPRIATE ORDINANCE RECORDS OF SAID CITY AND PROVIDYNG AN
EFFECTIVE DATE.
WHEREASa the City of Fort Worths Texasy has heretofore entered into a contract
wrath Bill ShannonL Inc.. , for the malting and construction of
certain street improvements on the hereinafter described portions of streets avenues and
pubbic places in said Citj-a to®writ:
BAURLINE STREET From Finley Street to Sylvania Avenue, known and des-
ignated as Project No. 029-040097-00, a seven-inch
thick reinforced concrete pavement on a four-inch
thick cement stabilized base with seven-inch high
superimposed concrete curb on a forty-feet wide road-
way Six-inch thick concrete driveway approaches will
be constructed where specified and five-feet wide side-
walk will be constructed adjacent to the curb on both
sides of the street.

WHEREAS, by sundry proceedings heretofore pa3sed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 8947 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
~uHER:r;AS, the City Council of the City of Fort Y~orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 8947 , and
WHEREAa, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;

BE IN ORDAIIJED BY THE CITY COUNCIL OF TFiE CITY OF FORT WORTH,
TEXAS, THAT;
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments< The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and9ha11 be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:

III.
When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,

This ordinance shall take effect and be in full force and effect from and after
the date of its passage. Q

construction seven-inch thick reinforced concrete pavement on a four-inch thick cement stabilized base
with seven-inch high superimposed concrete curb on a forty-foot wide roadway. Six-inch thick concrete
driveway approaches will be constructed where specified and five-feet wide concrete sidewalk will be

Final measured quantities at contract unit prices yield an earned total price
for this contract of $234,919.28 which is $8,629.19 (3.811) over the revised
price. The overun is the result of differences between quantities estimated for
the contract documents and quantities actually used to complete the work.
Financing
Final payment is to be made from Project Number 29-040097-00. A bond fund
transfer is needed in the amount of $8,700.00.

The project has been completed in accordance with the requirements of the
contract.
Recommendation
It is recommended that the City Council:
1. Approve the following bond fund transfer:
