ORDINANCE NO. /~~'~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING THE WESTERN 100 FEET OF THE 1400 BLOCK OF WEST
OLEANDER STREET, FROM THE EAST RIGHT-OF-WAY LINE OF
FAIRMOUNT AVENUE EASTWARD 100 FEET TO THE WEST RIGHT-OF-
WAY LINE OF A 12-FOOT WIDE NORTH/SOUTH ALLEY; PROVIDING
FOR REVERSION OF FEE IN SAID LAND; RETAINING A UTILITY
EASEMENT IN SAID LAND FOR EXISTING AND PROSPECTIVE
UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXA5:
SECTION 1.
-P THAT the western 100 feet of the 1400 block of West Oleander
Street, from the east right-of-way line of Fairmount Avenue eastward
100 feet to the west right-of-way line of a 12-foot wide north/south
alley, be and the same is vacated, abandoned and permanently closed
and extinguished as a public street right-of-way.
SECTION 2.
That the fee to the land in the above described vacated public
street right-of-way is hereby released and shall revert to the adja-
cent owners as provided by law, SAVE AND EXCEPT that easements are
retained for any and all existing and prospective utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Pulmonary Associates, with the written consent of all abutting property owners,
has requested that the City vacate the western 100' of the 1400 block of West
Oleander Street from Fairmount Avenue eastward 100' to the west right-of-way
line of a 12' wide north/south alley.
The subject street right-of-way, acquired by dedication, is open on the ground
and contains street light, electric, and telephone utility facilities. The
subject vacation request has been submitted to permit the replatting of the
vacated right-of-way with adjacent property, in order to expand the building
area and provide more usable yard space.
The necessary and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City.
Reviewing City departments and private utility companies have raised no objec-
tions to this request provided the vacated right-of-way is replatted with
adjacent property and the necessary utility easements retained for the existing
utilities.
The City Plan Commission has reviewed this request and recommends that the
subject street right-of-way be vacated as requested.
RECOMMENDATION:
It is recommended that an Ordinance be adopted vacating the 27' wide right-of-
way of the 1400 block of West Oleander Street from Fairmount Avenue to the
western right-of-way line of the north/south alley, as recommended by the City
Plan Commission.
