AN ORDINANCE AMENDING ORDINANCE NO. 8770 TO ADJUST THE
AMOUNT OF ASSESSMENTS FOR PART OF THE COST OF IMPROVING A
PORTION OF BRIDGE STREET AND BRIDGEWOOD DRIVE AND PORTIONS
OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS, SAID ASSESSMENTS BEING HERETO-
FORE LEVIED BY SAID ORDINANCE NO. 8770; PROVIDING THAT ALL
OTHER PROVISIONS OF SAID ORDINANCE NO. 8770 NOT SO AMENDED
SHALL REMAIN IN FULL FORCE AND EFFECT; DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING
THE CAPTION OF SAME IN THE MINUTES OF THE CITY COUNCIL OF
FORT WORTH, AND BY FILING THE ORDINANCE IN THE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on March 29, 1983, the City Council of Fort Worth
passed Ordinance No. 8770, closing the benefit hearing and levying
assessments for part of the costs of improving a portion of Bridge
Street, Bridgewood Drive and sundry other streets, avenues and
public places in the City of Fort Worth, Texas, said assessments
being levied in strict compliance with and under and by virtue of
Article 1105b of the Revised Civil Statutes of Texas; and
WHEREAS, all the proceedings with reference to the making of
the improvements have been regularly had in compliance with law and
all prerequisites to the levy of said assessments required by law
have been performed; and
WHEREAS, the improvements for which the assessments were levied
are to be accomplished under two contracts, the first contract to
provide for excavation and installation of drainage facilities and
the second contract for paving; and
WHEREAS, at the time of the levy of the assessments by
Ordinance No. 8770, the first contract (excavation and drainage) had
been awarded and the second contract (paving) had not; and
WHEREAS, the assessments were levied in regard to the paving
portion of the improvements after consideration, adoption, and
approval of an engineer's estimate of cost for said portion of the
improvements, as provided by law, said assessments, however, having
been made and levied by the City Council as it deemed just and
equitable, having in view the ,special benefits in enhanced value to
be received by such parcels of property and the owners thereof, and
apportioned so as to produce a substantial equality of benefits
received and burdens imposed; and
WHEREAS; subsequent to the levy of said assessments by
Ordinance No. 8770, competitive bids for the construction of the

paving portion of the improvements have been received after adver-
tisement as required by law; and
WHEREAS, the low bid for said contract is in an amount which is
less than the engineer's estimate of the costs of said portion of
the improvements referenced above; and
a
WHEREAS, the City Council now desires to adjust the amount of
the assessments heretofore levied by reducing the amount of the
assessment for each parcel and owner in proportion to the amount by
which the aforesaid bid is less than said engineer's estimate; and
WHEREAS, the City Council desires to amend said Ordinance
No. 8770 to reflect said adjustment;
NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF FORT WORTH, TEXAS:
SECTION 1.
That Ordinance No. 8770, passed by the City Council on
March 29, 1983, and on file in the office of the City Secretary of
Fort Worth, Texas, be and the same is hereby amended by substituting
the following in place of Section III of said ordinance, so that
Section III of said ordinance shall hereafter read as follows:
"III.
"There shall be, and is hereby, levied and assessed
against the parcels of property herein below mentioned,
and against the real and true owners thereof (whether such
owners be correctly named herein or not) the sums of money
itemized below opposite the description of the respective
parcels of property and the several amounts assessed
against the same, and the owners thereof, as far as such
owners are known, being as follows:
SECTION 2.
That all other provisions of the aforesaid Ordinance No. 8770
shall remain in full force and effect.
SECTION 3.
The City Secretary is hereby directed to engross and enroll
this ordinance by copying the caption of same in the Minute Book of
the City Council of Fort Worth, Texas, and by filing the complete
ordinance in the appropriate Ordinance Records of said City.
SECTION 4.
This ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Origin of Project
On Apr-il 5, 1980, the citizens of Fort Worth approved a $47,813,000 bond program
for street and storm drainage improvements and on May 20, 1980 (M&C G-4548), the
City Council allotted the funds into specific categories. One of the categories
was Major Thoroughfares and Collectors, which included Bridge Street-John T.
White Road Connection, at an estimated construction cost of $3,506,000.
Improvements
Bridge Street will be improved with major thoroughfare grade concrete pavement
with concrete curb, complete with turn lanes, street lights and required
drainage facilities. The improvements are being accomplished in two contracts to
allow for major utility relocations. Contract I (M&C C-6780), was awarded on
March 1, 1983 and provided for the excavation and shaping of the new roadway and
the installation of required drainage facilities save storm drain inlets which
are included in Contract II. Contract I and utility adjustments have now been
completed and Contract II was advertised for bids.
Receipt of Bids ~ '
Contract II, Paving and Street Lighting, was advertised for bids on December $
and 15, 1983, and the following bids were received on January 5, 1984,, with 100
working days allotted to complete the project.

Adjustment of Assessments
On March 29,-1983 (M&C G-5574), the benefit hearing for this project was
conducted by the City Council. The benefit hearing was closed and assessments
levied based on the actual unit prices on Contract I and the Engineer's Estimate
for Contract Il,,with stipulation that such assessments would be adjusted, based
on actual unit prices, at such time as Contract II was awarded.
The engineers' estimate for Contract II at the time the assessments were
calculated was $1,17$,259.48. The current low bid, as indicated above, is
$1,035,292.66 which will reduce the total assessments, on the entire project
from $243,040.69 to $222,986.02 as indicated below

It is recommended that Ordinance No. 8770, adopted on March 29, 1983, levying
the assessments based on Contract I and the Engineers' Estimate, be amended by
adjusting the assessments based on actual unit prices in Contract I and Contract
II (this contract), as outlined above. All of the adjacent property owners were
notified of this recommendation by certified mail on January 10, 1984.

Project Cost and Financing
Contract I was financed entirely by the City from Account No. 029-023-176-00 and
021-095-901-00. Based on standard City Policy in effect on March 29, 1983, cost
to adjacent property owners on Contract I and II is $222,986.02, which will be
provided for by a bond fund transfer from the "Revolving Fund Unspecified." Cost
to the City for construction in Contract II is approximately $778,254.64, and
$72,470.48 for Engineering plus $57,330.00 for street lighting. Bond fund
transfers are required for all City costs in Contract II.
Recommendations
It is recommended that:
1. A construction contract be awarded to J. L. Bertram Construction
Engineering, Inc . in the amount of $1, 035, 292.66 based on their low
for paving and street light improvements,
2. An Ordinance be adopted amending Ordinance No. 8770, adjusting th
assessments as indicated above, and,
3. The following bond fund transfers be approved.,
