HomeMy WebLinkAboutOrdinance 9222 ~j .. .1 ~.e. ~ __ .Z ~.1 Y,. ~ r. w ORDINANCE NO. ~o~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE 10-FOOT WIDE NORTH/SOUTH ALLEY LOCATED IN BLOCK 18, JENNINGS SOUTH ADDITION, FROM WEST DAGGETT AVENUE NORTH TO WEST JARVIS STREET; PROVIDING FOR REVER- SION OF FEE IN SAID LAND; RETAINING UTILITY EASEMENTS IN SAID LAND FOR EXISTING AND PROSPECTIVE UTILITIES; REPEAL- ING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the 10-foot wide north/south alley located in Block 18, Jennings South Addition, from West Daggett Avenue north to West Jarvis Street, be and the same is vacated, abandoned and permanently closed and extinguished as a public alley right-of-way. SECTION 2. That the fee to the land in the above described vacated public alley right-of-way is hereby released and shall revert to the adja- cent owners a provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts or ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. J. Justin & Sons, Inc., with the written consent of all abutting property owners, has requested that the City vacate the 10' wide north/south alley in Block 18, Jenning South Addition from West Daggett Avenue north to West Jarvis Street, as shown on the attached map. The subject alley right-of-way, acquired by dedication, is open on the ground and contains sewer and electric utility facilities. The subject vacation request is made in order to replat the vacated right-of-way with adjoining property, thus expanding the building area and providing more usable yard space. The subject alley vacation request was submitted and reviewed prior to the adoption of the City's compensation policy, therefore, compensation for the vacated alley right-of-way is not required. Reviewing City departments and private utility companies have raised no objec- tions to this request, subject to the vacated alley right-of-way being replatted with adjacent property, and being retained/dedicated as a utility easement for existing utilities. A satisfactory replat, which retains and dedicates the necessary and appropriate easements, has been submitted. The City Plan Commission has reviewed this request and recommends that the subject alley right-of-way be vacated as requested. RECOI~IlKENDATION It is recommended that the City Council adopt an ordinance vacating the 10' wide north/south alley in Block 18, Jennings South Addition, as recommended by the City Plan Commission.
