HomeMy WebLinkAboutOrdinance 9223~:= fi• - ;':' ~, ~-`, ORDINANCE NO. 9~~ .~, •r . - ~ .. ~> AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING A PORTION OF CERTAIN UTILITY AND SANITARY SEWER EASEMENTS LOCATED IN LOTS 1 AND 2, BLOCK 2, RIVER PARK ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE following be and the same are vacated, abandoned, and permanently closed and extinguished as a public utility easement and sanitary sewer easement, respectively: A. A portion of that certain Texas Electric Service Company utility easement located in Lots 1 and 2, Block 2, River Park Addition, as described in deed recorded in Volume 1296, Page 75, Deed Records, Tarrant County, Texas, and being more particularly described in Exhibit "A", attached hereto and incor- porated herein; B. A portion of that certain sanitary sewer easement located in Lots 1 and 2, Block 2, River Park Addi- tion, as described in deed recorded in Volume 7117, Page 1702, Deed Records, Tarrant County, Texas, and being more particularly described in Exhibit "B", attached hereto and incorporated herein. SECTION 2. That the fee to the lands in the above described vacated public utility easement and sanitary sewer easement are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. The subject utility ~ easements are as shown on the attached map. ~ The subject utility easements, acquired by deed, are platted but contain no utility facilities. The subject vacation request is made in order to incor~ porate the vacated easement rights-of-way with adjacent property, thus expanding the building area and providing more usable yard space. It is the opinion of the Real Property Department that the interest of the City ~ in the subject utility easements described in this vacation request, have no monetary value to the City if same are vacated. Reviewing City departments and private utility companies have raised no objec- tions to this request. RECOIKMEENDATION: It is recommended that the City~Council adopt an ordinance vacating Texas Electric Service Co. utility easement and the 20' wide sanitary sewer utility easement in Lots 1 ~.nd 2, River Park Addition.
