(V-83-29)
R. D. Ryno, with the written consent of all abutting property owners, has
requested that the City vacate the 10' wide north/south alley, adjacent to
Block 1, Ryno Realty Addn., and Tracts 8, 9 and 14-19, A. Robinson Survey, from
West Weatherford Street southward to the north property line of Lot 3-R,
Conner Subdivision, as shown on the attached map.
The subject alley right-of-way, acquired by dedication, is not open on the
ground, but contains sewer, electric, and telephone utility facilities. The
subject vacation request is made in order to repiat the vacated right-of-way
with adjacent property, thus expanding the building area and providing more
usable yard space.
Since the subject vacation request was submitted prior to July 1, 1983, it is
not subject to the adopted remuneration policy/ordinance.
Reviewing City departments and private utility companies have raised no objec-
tions to this request, subject to the vacated right-of-way being replatted with
adjacent property, and being retained/dedicated as a utility easement for
existing utilities. A satisfactory replat, which retains and dedicates the
necessary and appropriate easements, has been submitted.
The City Plan Commission has reviewed this request and recommends that the
subject alley right-of-way be vacated as requested.
RECOMMENDATION•
It is recommended that an ordinance be adopted vacating the 10' wide north/
south alley in Block 1, Ryno Realty Addn., and Tracts 8, 9 and 14-19, A.
Robinson Survey, as recommended by the City Plan Commission.
