HomeMy WebLinkAboutOrdinance 22180-05-2016 ORDINANCE NO. 22180-05-2016 AN ORDINANCE VACATING AND EXTINGUISHING SCARLET COURT, AZURE LANE, SABLE TRAIL AND PORTIONS OF RUSSET TRAIL, CRIMSON LANE, SCARLET LANE ALL SITUATED IN BLOCK 20 OF THE SHELBY COUNTY SCHOOL LAND SURVEY, ABSTRACT NO. 1375, TARRANT COUNTY, TEXAS, ACCORDING TO THE PLATS OF CRIMSON RIDGE SECTION ONE, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN VOLUME 388-165, PAGE 64, AND VOLUME 388-57, PAGE 70 OF THE REAL PROPERTY RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING APPROXIMATELY 211,981 SQUARE FEET OR 4.867 ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That all of Scarlet Court, Azure bane, and Sable Trail and portions of Russet Trail, Crimson Lane, and Scarlet Lane, all situated in Block 20 of the Shelby County School Land Survey, Abstract No. 1375, Tarrant County, Texas, according to the plats of Crimson Ridge Section One, an addition to the City of Fort Worth, Tarrant County, Texas; as recorded in Volume 388-165, Page 64, and Volume 388-57, Page 70 of the Real Property Records of Tarrant County, Texas and containing approximately 211,981 square feet or 4.867 acres of land more or less, and as more specifically described in Exhibit "A" attached hereto and incorporated herein by reference be and the same are vacated and extinguished. That the easements to the land in the above-described vacated street rights of way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Adopt the attached ordinance vacating Azure Lane, Scarlet Court and Sable Trail along with portions of Scarlet Lane, Crimson Lane and Russet Trail to be replatted by Crimson Ridge Land Partners and Everman Independent School District for a multi-family development and school uses; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Wier and Associates, Inc., on behalf of Crimson Ridge Land Partners, LLC, and Everman Independent School Districts, has requested the vacation of these rights-of-way, to be replatted with the adjoining vacant property for a new multi-family development and school uses. The City Plan Commission recommended approval of this request at its meeting on November 20, 2015. An acceptable final plat (FP-15-120) has been received in accordance with the Subdivision Ordinance. The City Plan Commission approved a waiver allowing the applicant five years from the date of the recommendation to include all portions of right-of-way in a final plat since the Everman ISD has no plans for development at this time. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the rights-of-way easements. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets. This project is located in COUNCIL DISTRICT 8, Mapsco 106P. This M&C does not request approval of a contract with a business entity.
