AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE TALON HILL PHASE I PROJECT OF THE TRANSPORTATION IMPACT FEE FUND IN
THE AMOUNT OF $472,214.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF
CONTRUCTING LAKE COUNTRY DRIVE FROM ROBERTSON ROAD TO EXISTING EAGLE
RANCH BOULEVARD UNDER A COMMUNITY FACILITIES AGREEMENT WITH BYD
TALON HILL DEVELOPMENT LLC AND DECREASING FUND BALANCE IN THE
UNSPECIFIED CENTER OF THE SERVICE AREA E FUND BY THE SAME AMOUNT;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the
City Manager, there shall also be increased estimated receipts and appropriations in the Talon Hill Phase 1 Project of the
Transportation Impact Fee Fund in the amount of$472,214.00, from available funds, for the purpose of constructing Lake
Country Drive from Robertson Road to the existing Eagle Ranch Boulevard, under a Community Facilities Agreement
with BYD Talon Hill Development LLC and decreasing fund balance in the unspecified center of the Service Area E
Fund by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason
by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions,
sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other
ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are
hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Estimated Project Amount of$1,179,921.00 Including City Participation in an Amount Not to Exceed

and Adopt Appropriation Ordinance (TRANSPORTATION IMPACT FEE FUNDS) (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an appropriation ordinance increasing estimated receipts and appropriations in the Talon Hill
Phase 1 Project, of the Transportation Impact Fee Fund in the amount of$472,214.00 and reduce the
fund balance in the Unspecified Center of the Service Area E Fund by the same amount; and
2. Authorize the execution of a Community Facilities Agreement with BYD Talon Hill Development LLC, in
the estimated project amount of$1,179,921.00, which includes City participation in an amount not to
exceed $472,214.00 to construct Lake Country Drive from Robertson Road to the existing Eagle Ranch
Boulevard.
DISCUSSION:
The purpose of this M&C is to authorize execution of a Community Facilities Agreement (CFA) with BYD
Talon Hill Development LLC, the developer of the proposed Talon Hills Subdivision located generally north
and west of Eagle Ranch Boulevard, for the construction of four lanes of Lake Country Drive from
Robertson Road to Eagle Ranch Boulevard. The City will participate in the oversizing of the road
construction in order to have Lake Country Drive built out to its ultimate configuration through this
area. The table below reflects the delineation of construction costs and related fees between the
developer and the City. These costs are based upon the adopted unit costs estimated for this project by
Kimley Horn Associates within the City Council adopted 2013 Transportation Impact Fee Study update
(identified as project E-8).
