HomeMy WebLinkAboutOrdinance 9130'~ ty r ~ " >. i ~ r z .~ i{ ORDIANCE~NO. ~~~ AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE N0. 8282, BY INCREASING FROM 175 TO 275 THE MAXIMUM NUMBER OF TAXICABS PERMITTED TO BE OPERATED BY THE FORT WORTH CAB AND BAGGAGE COMPANY; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCE; PROVIDING A SAVINGS CLAUSE: PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. r WHEREAS, by Ordinance No .. 7265, the City Council of ~--: ~ the City of Fort Worth, Texas, granted the Fort Worth Cab and Baggage Company the privilege of providing taxicab service in the City of Fort Worth for a term of ten (10) years ending December 31, 1985; and WHEREAS, among other items provided, Ordinance No. 7265 authorized the operation of a maximum of 125 taxicabs, although at such time Fort Worth Cab and Baggage Company had approximately 66 taxicabs in use on City streets; and WHEREAS ,due to the change in the Fort Worth Cab and Baggage Company's method of operations by the establishment of a "driver-owner" and "lease-car" driver system, there is now a greater demand for taxicabs and taxicab service; and WHEREAS, the City Council of the City of Fort Worth, Texas on March 13, 1981 by Ordinance No. 8282; increased the maximum number of taxi permits to 175; and WHEREAS the licensing branch of the City of Fort Worth Police Department continues issuing of additional taxi-driver permits, tYiir.ty (30) in the most recent week; and, WHEREAS,~.Fort Worth Cab and Baggage Company now has 155 cabs on the streets of Fort Worth, and is rapidly approaching the limit of 175 taxicabs as authorized by Ordinance No. 8282; and WHEREAS, if satisfactory taxicab service is continue to be afforded to Fort Worth patrons, the present number of taxicabs authorized to operate within the City should be increased, consistent with the demand and necessity for such taxicab service; and .. +R ~ r s L WHEREAS the City of Fort Worth has made due inquiry into the said Fort Worth Cab and Baggage Company application for the authorization of additional taxicabs, and upon such inquiry and after a thorough consideration of all the facts made available to it, the City Council finds: 1. That Public convenience and necessity supports the request of the Fort Worth Cab and Baggage Company to increase the maximum number ,- of taxicabs authorized from 175 to 275. 2. That the general welfare of the community will be best served by increasing the maximum number of taxicabs authorized from 175 to 275; and 3. That all other prerequisites as contained in Chapter 34, Code of the City of Fort Worth, Texas (1964), as amended, have been met; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 1 of City of Fort Worth Ordinance No. 8282 is hereby amended by increasing from 175 to 275 the maximum number of taxicabs authorized to be operated by the Fort Worth Cab and Baggage Company within the municipal limits of the City of Fort Worth. All other terms and provisions of Ordinance No. 8282 shall remain in full force and effect. SECTION 2. That this ordinance shall repeal every prior ordinance in conflict herewith only insofar as any portion of such ordinance shall be in conflict, and as to all other oridinances not in direct conflict herewith, such ordinances shall remain in full force and effect, and this ordinance shall be and is hereby made cumulative. SECTION 3. That ail rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of Ordinance No. 8282 or any amendments thereto, which have accrued at the time of the effective date of this ordinance; and as to such accrued violations, the Court shall have all of the powers that existed prior to the effective date of this ordinance. L ~~ SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrases, clause, sentence, paragraph or section of this orodinance shall be decalred unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. That this ordinance shall become effective and be in full force and effect from and after the date of its passage, and it is so ordained.. In Ordinance No. 7265, the Fort Worth Cab and Baggage Company was granted a privilege to operate taxicab service in Fort Worth for a term of ten years, expiring December 31, 1985. This grant of privilege provided authorization for operating a maximum of 125 taxicabs. Because the company's business had grown, the City Council in 1981 approved an increase to a limit of 175 taxicab permits (M&C G-4883, Ordinance No. 8282). The number of cabs now operated is near the maximum limit, and on May 18, 1984, the company requested a further increase in .the number of cabs authorized. The investigation by the Utilities Supervisor indicates that the new system of taxi operations using driver-owners and lease-car drivers has placed more cabs on the street and has improved general service levels. The request for additional taxi- cabs complies with all provisions of the City's Taxicab Ordinance (Chapter 34, of the Code of the City of Fort Worth 1964, as amended) and is in the public interest. An ordinance has been prepared amending Section 1 of Ordinance No. 7265 by increasing to 275 the maximum number of taxicabs which Fort Worth Cab and Baggage Company is authorized to operate in the City of Fort Worth. Recommendation: It is recommended that the City Council: 1. Conduct a public hearing on the request of Fort Worth Cab and Baggage Company, and 2. Adopt the attached ordinance increasing from 175 to 275 the maximum number of taxicabs authorized to be operated by the Fort Worth Cab and Baggage Company.
